Federal appeals court allows Texas to leave floating barrier in Rio Grande for now

A federal appeals court Thursday put on hold a judge's order from earlier this week requiring Texas Gov. Greg Abbott to remove a floating barrier from the middle of the Rio Grande.

The 5th Circuit U.S. Court of Appeals allowed Abbott, a Republican, to leave in place for now the 1,000-foot barrier the state installed to deter illegal migrant crossings. The order was issued by a three-judge panel of two Democratic appointees and a Republican appointee.

Wednesday, U.S. District Judge David Ezra had ordered that the barrier moved out of the main waterway to the bank of the Rio Grande on the Texas side by Sept. 15, granting the Justice Department's request for a preliminary injunction while the case is litigated.

I agree. I am sure the plaintiffs are already shopping for a friendlier court to file their appeal.

Maybe they want it gone because it’s wreaking havoc on the environment, emitting dangerous carbon gases, keeping illegals away so they can vote democrat, sell drugs and beat up white people and encroaching on the habitat of the The Malagasy rainbow frog?

The only venue to appeal to from the circuit court with jurisdiction is to the Supreme Court. However, this only overturns the injunction from the district court; the issue still needs to be tried.

Call up the Texas National Guard. Deputize them all as Texas Rangers. Stop all persons crossing the river.

The thing to keep in mind with a Wall or any barrier is not the barrier itself, but why are people even crossing illegally today? After all, all they have to do is check-in a legal entry point, and Biden has ordered US Immigration to push them North.

The answer is that the people who still cross illegally do so because they have FELONY charges pending against them in the US - those are the ones barriers like this stop (or at least slow down a bit). That’s what we’re now arguing about: Should felons have the right to enter this country?

As a fundamental matter, and as I understand it, the federal government is a creation of the states. To act in the interests of all the states. If the pool boy can’t or won’t clean the pool, you do it yourself until you can hire someone else.

Dan Bongino had a guest on yesterday who was some official from Texas (sorry I do not recall his name or office).

The gentleman stated that this 1,000’ area is the most dangerous section of the river and, literally a thousand or more ‘crossers’ have drowned in this area.

Apparently the two cemeteries on either side of the border have become 100% filled up with these deceased folks.

It was very sad to hear but it’s pure evil on the part of this Administration to go after this 1,000’ section.

That’s a much kinder barrier than my idea. I proposed anchoring rolls of razor wire to the bottom at all wadable crossing spots.

The floats were actually installed to protect people. This is a curve in the river with a fast current and many “migrants” drowned trying to cross it. It only extends for 1000 feet and only covers that dangerous part of the Rio Grande.

I thought it was much more than 1000 feet, it needs to be the entire length of the Rio Grande. I guess if they win this case, they can go and extend it. The federal government should buy it, but only with the agreement to keep it in place.

DeSantis should pick Abbott to lead DHS in the next administration. Let him secure that border. all of it.
