A new proposed rule by the Bureau of Alcohol, Tobacco, Firearms and Explosives would increase what is required to obtain a federal firearms license (FFL) for gun sellers across the country -- an attempt to end what gun control advocates term "the gun show loophole."
Justice Department officials told reporters that prior to the Bipartisan Safer Communities Act, which was signed into law last June, those "engaged in the business" of a firearms dealer were defined broadly. The definition that ATF is proposing is more specific in an effort to better regulate the market in accordance with the new federal law.
"The prior definition before that, [before] the BSCA was implemented and signed by the president, focused on when a person earns their livelihood from dealing in firearms," a senior DOJ official said on the call with reporters. "The revised, new definition covers anyone devotes time, attention and labor to dealing with firearms as a regular course of trade or business to predominantly earn a profit. So, the rulemaking is focused on that new terminology to predominantly earn a profit."
"The proposed rule would amend the ATF regulations to clarify that firearm dealing that requires a license and conduct conducting a background check does not solely occur in brick-and-mortar stores," a senior DOJ official said. "It also encompasses dealing at gun shows flea markets mail order and over the internet. The proposed rule reinforces and makes clear that there is no gun show loophole, there is no internet loophole recognized under federal law. Instead, a gun dealer must obtain a license and run background checks, no matter what menu that person engages in this."

The “gun show loophole” is actually about banning private sales/transfers.
In many states you can sell/gift your gun to another individual without having to go through an FFL.

The thing that doesn’t make sense to me is this rule shouldn’t stop the average person who bought a gun, used it for a while & found it didn’t meet their needs, & turns around & sells it to someone else. Without a background check. They aren’t making a profit, they’re just recovering their purchase price to be used elsewhere.
What does this rule really solve?
All gun problems were solved back in 1968. the democrats said so till the ink was dry on the 1968 gun control law, then they started crying for more legislation.

ACLU Files Lawsuit for Child Murderer Denied Transgender Surgery
The American Civil Liberties Union (ACLU) in the state of Indiana has filed a lawsuit for a child murderer being refused transgender surgery.

This past July, Indiana passed a law that essentially bans the use of state or federal dollars to help transition inmates who identify as transgender. The lawsuit from the ACLU has been filed on behalf of Autumn Cordellioné, also known as Jonathan C. Richardson, who murdered his 11-month-old stepdaughter in 2001. According to Reduxx, Richardson had told police at the time that he found the infant “unresponsive” after doing household chores, but his story changed dramatically after several interviews until he eventually confessed to violently shaking the baby to handle her fussiness:
While awaiting his eventual court hearing, Richardson reportedly told a prison official, “all I know is I killed the little fucking bitch.” He was subsequently sentenced to 55 years in prison.

Michael was parked in a rest area off I-10 in New Mexico when he witnessed a pick-up truck pull up nearby. A man and woman proceeded to unlock a padlocked cage beneath a tarp in the back of the truck, from which they released several children.
According to the video uploaded by the truck driver, the kidnappers were seen ushering the children into and out of a bathroom at the rest area before locking them back into the cage.
“I’m sitting at a rest area. This truck pulls up, opens up the back. It’s like a cage-looking thing… That guy and this lady have a whole bunch of kids in the back of that truck… And then they take the padlock off, raise the tarp, and all these kids come out the back, and they’re forcing them into the bathroom,” Michael said.
“I called 911… I don’t know what’s going on. I’m not real big on calling the cops, but when it comes to kids and their safety and with all this human trafficking and all this crap going on in the world, not cool. So I call the cops just to be on the safe side,” Michael added. “It was about 15, I would say,” Michael said. Michael said the little girls that he saw were no older than three or four years old.

Well; you need to HAVE gun before you can sell it in the wrong manner; so, in order to alleviate the problem, you shouldn’t have the gun in the first place!
The ATF cannot legislate. What they want to do by re-defining has already been tested by the Supreme Court and they ruled the ATF could not legislate by re definition.
I’m 75 and have never sold a firearm in my life. Have bought a few and inherited a few. And will keep what I have. This is still Texas where I live. My neighbors agree on this issue.
