Trump can’t be barred from Arizona’s 2024 ballot, says Democratic secretary of state

Arizona Secretary of State Adrian Fontes (D) said he does not have the ability to bar former President Donald Trump from running for president in his state Wednesday.

There have been calls to bar the former president from being able to run in 2024 related to language in the 14th amendment where it states those who “have engaged in insurrection or rebellion” against the government cannot hold office. Fontes said despite those claims, he cannot do so by way of a previous Arizona Supreme Court case.

“Now, the Arizona Supreme Court said that because there’s no statutory process in federal law to enforce Section 3 of the 14th amendment, you can’t enforce it,” Fontes said on “The Gaggle” podcast by The Arizona Republic and azcentral.com.

“That’s what the Arizona Supreme Court said, so that’s the state of the law in Arizona. Now, do I agree with that? No, that’s stupid,” Fontes continued.

Fontes said despite his dislike of what the Arizona Supreme Court has decided, he will still follow it because it is Arizona law.

“What I’m saying is I’m going to follow the law,” Fontes said. “And the law in Arizona is what the law in Arizona is. Whether I like it or not, is irrelevant.”

The fact that a Secretary of State makes a grand announcement that he will follow the law, as if he’s being magnanimous in doing so, is yet another symptom of our completely screwed up government. And had the state Supreme Court not ruled against him, he would have definitely proceeded with his unconstitutional, lawless plan.

Spot on....no insurrection charges have ever been made. Fontes is grandstanding, let his peeps know he’d love to be the one, his D heart is in the right place, but dang...the law prevents it.

Well, I think that will be pretty irrelevant, because even if a few states do remove him from the primary ballot, I still don’t think that would help anyone to overcome Trump in the primary.

And if they remove the opposition candidate from ballot for the general election, well, there’s no way the Supreme Court can avoid taking up such an issue, since it would be a Constitutional conflict between the states and the federal government. If they did, well, they’ll have blood on their hands when the issue gets resolved on the streets instead.

If the AZ Supreme Court said there’s no enforcement provision in federal law it would seem to suggest federal law would have to change. But GOP has the House else we know Pelosi would have rammed through something. I want to see Dems campaign on killing democracy to save democracy.

Presuming Trump gets the GOP nomination, this ensures he will be on the ballot in AZ. But that begs a bigger question - Can he carry this swing state? Most likely not, even though Republicans outnumber Democrats in party registration. Here’s why:

While most FR participants despise everything about John McCain, a large contingency of Arizona Republicans revere him to this day. Throughout his one term as President and before McCain passed away, Trump pilloried him with vicious character assassinations. Referring to McCain’s service in Viet Nam, Trump belittled him, saying “Real heroes don’t get captured!”

At that moment, countless AZ GOP voters swore up and down to never cast a vote for Trump. Trump carried AZ in 2016 by 3.5%. Following this stupid, unforced error he couldn’t replicate that performance in 2020. Further, his coat tails were non-existent in 2018 as he desperately tried to carry Martha McSally over the finish line in that Senate race. Same for 2022 when he failed to produce a victory for Blake Masters.

A Republican can win statewide in this crucial swing state (and numerous others), as evidenced recently by Doug Ducey. Trump cannot win AZ, and hopefully GOP voters will give serious focus to the electability matter before it’s too late.
