Arizona Secretary of State Adrian Fontes (D) said he does not have the ability to bar former President Donald Trump from running for president in his state Wednesday.
There have been calls to bar the former president from being able to run in 2024 related to language in the 14th amendment where it states those who “have engaged in insurrection or rebellion” against the government cannot hold office. Fontes said despite those claims, he cannot do so by way of a previous Arizona Supreme Court case.
“Now, the Arizona Supreme Court said that because there’s no statutory process in federal law to enforce Section 3 of the 14th amendment, you can’t enforce it,” Fontes said on “The Gaggle” podcast by The Arizona Republic and azcentral.com.
“That’s what the Arizona Supreme Court said, so that’s the state of the law in Arizona. Now, do I agree with that? No, that’s stupid,” Fontes continued.
Fontes said despite his dislike of what the Arizona Supreme Court has decided, he will still follow it because it is Arizona law.
“What I’m saying is I’m going to follow the law,” Fontes said. “And the law in Arizona is what the law in Arizona is. Whether I like it or not, is irrelevant.”

What happens when their anti-Trump lawfare operation fails AND their 14th Amendment effort fails, how far will they go when it comes to ridding the country of the “threat” posed by Trump? I have no doubt that the ultimate removal is already in the planning stages.
No state can bar him. The qualifications for President are defined by the Constitution, not by the states.

The absolute corruption and stupidity of democrats like this is just amazing. They seem to ignore the fact that in the Smith indictment and in the charging of all the J6ers, not a single one was charged with insurrection. So how the heck does this idiot and the other democrat idiots think they can keep Trump off the ballot when insurrection has not been charged let alone proved. Oh, I know, cause they want it to be. Mental illness is rampant among democrats.

The Democrats and the Republicans. It’s not Democrats in Arizona who are trying to keep Trump off the ballot, or rigging the election with fraudulent ballots.
Rather, I meant to say “it’s not ONLY Democrats in Arizona”.
It sounds like the issue is putting candidates on the ballot for the election. The states can’t bar him from running for president. But it’s apparently a different process to decide which candidates appear on the ballot.
In every election cycle, there are hundreds of official candidates for president. But most states only have a handful of such candidates on the ballot on election day. There are some criteria to decide which candidates appear on the ballot. The liberals apparently are going after the criteria to decide who gets on the election ballot.
“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability.”
Section 3 of the 14th Amendment does not cover the Presidency. It only mentions “ELECTORS OF PRESIDENT”. In addition, the Office of the President has NEVER been considered an office UNDER the United States and in David McKnight’s 1878 widely referenced book on the electoral system of the United States he writes that the Presidency is obviously not an office under the United States. Since the 14th Amendment was written in 1865/66, McKnight’s view in 1878 is much more in line with the thinking of the time than modern opinions 140+ years later.

This will not stop other blue states from trying to do this end around of the Constitution.

That may not be true for a party primary. I would feel better if the rat SOS did not surrender this easily. When the rats stole the AZ Governor,SOS and AG they also killed the voter ID initiative. Like Lake it has a 10 point lead in the state polls.
