A federal appeals court on Friday ordered a new sentence for a North Carolina man who pleaded guilty to a petty offense in the Capitol riot — a ruling that could impact dozens of low-level cases in the massive Jan. 6, 2021 prosecution.
The appeals court in Washington said James Little was wrongly sentenced for his conviction on a misdemeanor offense to both prison time and probation, which is court-ordered monitoring of defendants who are not behind bars.
Little, who entered the Capitol but didn't join in any destruction or violence, pleaded guilty in 2021 to a charge that carries up to six months behind bars. He was sentenced last year to 60 days in prison followed by three years of probation.

Let me offer a prayer that neither you nor anyone dear to you should ever find yourself in a like situation.
I’m pretty sure I’m not nor any in my family, will go to the capitol building to protest anything. And for sure not break windows or sit in anybody seat or take items that don’t belong to us. If they would have stayed outside and chanted, our party would be better off right now. Even the wacky democrats just throw on silly handsmaid clothes and just stand there. The message was given without saying a word or going anywhere in the capitol but where authorized.

Many folks plead guilty who are totally innocent.
They weigh the odds of being convicted in a kangaroo court and decide the kangaroos have the best chance of winning.
I saw a video of Dr. Gold. She gave a speech on medical freedom from inside the Capital on January 6th. She and the guy recording her were threatened with years (decades?) in prison unless they copped a plea for a lesser sentence. Their crime was to enter the Capital after Capital police opened the doors for people to enter. She copped a plea and, after serving a short time, was released. As far as I know, the videographer is still in jail awaiting a trial.
This is the way business is done under the Biden administration. Say you are guilty, or else risk spending the rest of your life in jail. I don’t put much stock on these coerced confessions.
At one point, Lamberth was probably a good guy. He presided over the Scooter Libby persecution. He should have had the sense to throw the whole thing out and sanctioned the prosecution. At some point, he seems to have decided that Government must triumph over all. He stinks.
Maybe he is a schizo judge who usually votes with the commies, but they may have been shocked At that ruling and statement against DC jails less than 2 years ago.

You weren’t threatened with years of hard time for not pleading guilty to a misdemeanor.
I wasn’t there. Why would I? I was smart enough to stay away from DC that day. It was a disaster waiting to happen and they walked right into it.
