“One day in 1973, a state bureaucrat entered Milk’s shop Castro Camera and informed him that he owed $100 as a deposit against state sales tax. Milk was incredulous and traded shouts with the man about the rights of business owners; after he complained for weeks at state offices, the deposit was reduced to $30. Milk fumed about government priorities when a teacher came into his store to borrow a projector because the equipment in the schools did not function. Friends also remember around the same time having to restrain him from kicking the television while Attorney General John N. Mitchell gave consistent “I don’t recall” replies during the Watergate hearings. Milk decided that the time had come to run for city supervisor.”

I think the fine is excessive and that it violates Amendment VIII.

Not only is it excessive, the argument could be made that it is compelled speech if teachers do not want to teach about Harvey Milk. Compelled speech is a first amendment violation. I am not sure where the line gets drawn tho. For instance, is forcing teachers to teach math compelled speech? It seems the norm for teachers to not teach math these days, or something that resembles math as you and I know it.

1.6 million dollars to ship? WTF? No way! 1.6 to print and ship maybe with a massive royalty to some NGO or other scam like the Gov’s Presidential campaign fund, but not to SHIP! Either the news got the story wrong or there’s a massive scam going on. Did they charge 1.6 million to each of the 977 school districts?

Supreme Court Justice Felix Frankfurter said the most difficult freedom to accept is freedom for someone else to express the thought you hate.

Samuel Adams and Patrick Henry were “free” to say anything good about the British they wished. Just not anything against them.

A quiet effort to razor blade out the offending page by the members of the school board on a night after a school board meeting would have probably been unnoticed by everyone.

Even if someone noticed a page missing they would normally assume it was just a printing error and think nothing more about it.

So this was an UNFUNDED MANDATE by the state? The California Constitution prevents the state from creating unfunded mandates and shifting the costs for those mandates to local agencies like school districts. Sorry, Gavvy
