On March 15, 2020, two days after then-President Donald Trump declared a national COVID-19 emergency, Cornell law professor Michael Dorf urged Congress to impose a nationwide lockdown and suspend the writ of habeas corpus.
Congress never took either of those constitutionally dubious steps, which Dorf said were necessary to “save the nation.”
Instead, as Supreme Court Justice Neil Gorsuch noted this month, “executive officials across the country issued emergency decrees on a breathtaking scale,” amounting to one of “the greatest intrusions on civil liberties” in US history.

The Bill of Rights was simply abandoned. What a flex.
He confirmed that it had happened.
Why did he not speak up then? Did he need to think about it for 3 years?
He cones from the left, it takes a while to cone to these new ideas, if ever.
This is the only good one of Trump’s picks. And how many times did these issues come up in front of the USSC and the court supported these unconstitutional acts. Such as forcing vaccines on healthcare workers. Supporting violation of election laws, and on and on.
The democrats have learned they can control the vast majority at any time and for any reason.
Yeah, they didn’t do anything righteous like reverse Roe vs. Wade or no pro 2nd Amendment rulings, right?
What an asshole!
Hey, Neil, what took you so long?
SCOTUS had opportunities to intercede in the tyranny but they chose to weenie out of it.
I though the was a conservative who was an adherent to Constitutional rulings. That should have been an easy one. I’ve heard, that the 1917 Flu epidemic had mandatory masks in some areas, but I don’t think thy locked down this was a first, It was part of the plan to steal the 2020 elections by having more states use mail-in ballots.
...they are very good at coming up with new ways to kill us, you have to give it to them for that.
Republicans used to dislike Kennedy. Now they are cheering for someone to the left of him? Gorsuch was Trump's pick that was most firmly to the left. But hopefully that changes.
Look, I praised Gorsuch on this thread. I will praise him if he does something right, but I won't cheer for left leaning judges like you.
SCOTUS rarely intercedes in this manner because it is rare for an issue to be the subject of a legal challenge where a SCOTUS ruling is required to stop immediate and irreparable harm. In almost every case that is subject to important constitutional scrutiny, there is no harm in letting the case proceed through the normal appeal process — which can take several years.
I would point out, though, that it is likely the Supreme Court will be involved in the next few years quite a few cases involving civil rights violations by state and local governments — and many employers, too.
But you don't think Trump has ever made a mistake?
🙂 DeSantis can do nothing but ape Trump.
Just tonight drove past a small lake area restaurant, family owned for over 50 years. They were locked down to customers. Sadly, they resorted to selling pies in their parking lot to people going by. The business never recovered. Our fellow Americans did that all over the nation, and fully enjoyed the power surge in their panties.
