Debt ceiling: Support for 14th amendment solution mounts on Capitol Hill

The support on Capitol Hill for what was once a fringe legal theory is growing by the hour as the debt ceiling talks head into their final days.

On Thursday, a group of of 11 progressive senators led by Sens. Tina Smith (D-MN), Elizabeth Warren (D-MA) and Bernie Sanders (I-VT) released a new letter to President Biden calling on him to prepare to cancel the debt ceiling by invoking the 14th amendment.

The increased adoption of an idea that could roil markets is a reflection of growing Democratic anxieties that the White House could be preparing for deep compromise as ongoing direct negotiations with representatives of Speaker Kevin McCarthy continue.

Two different things

The debt ceiling is a limit on FURTHER spending. It does not negate the existing debt.

If anything, the 14th Amendment would require that debt payments be made a priority over further spending.

If you are talkng about any land other than forts, and ports, etc..and are referring to USFS and BLM and Parks etc, it aint theirs to sell.

Those lands are managed under a trust for the public. That trust can, and should be taken away from the feds and given to the local counties. If the counties do not want to manage that trust, then to the states.

There is NO “14th Amendment” solution present for the deficit spending that got us here. There is NONE- not any part of this Amendment could even “trend” from a Constitutional perspective. The Treasurer of the US has PLENTY of money to recognize actual debt— based on the incoming revenue to the US every single day within a month.
The answer is to PAY the debts in Priority- and within the income we have to pay them. Same as any other entity in the US. We can no longer keep expanding the borrowed money from the Fed Reserve only to add more spending of completely political nature. Period. Over and out.

The MONEY is in the Treasury- if the payment of the debts (servicing foreign owned instruments of US debt, US owned debt instruments, and all essential services- US military, national security, and even yes- social security FIRST, then pare back the idiotic unsupportable spending they KNOW we do not have nor need.

Section 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

This section seems to forbid reparations, doesn't it?

Correct. To allow federal reparations, the 14th Amendment would have to be repealed or modified.

Leftists, Read the 14th. It is very clear. The Predident is no where mentioned in th 14th. It clearly says “congress shall have the power”.

There is no way the SCOTUS could read it otherwise.
There is no way a literate person could read it otherwise.

The 14th amendment does not require borrowing money. It only requires paying debt. We can make our debt payments with our actual income collected from taxes, fees, tariffs, etc.

If they try it, my guess is the SCOTUS will strike it down within days. Totally unconstitutional. And I suspect the Republicans are already working on the briefs to file.
