Daniel Perry Denied Retrial After Fatal 2020 Texas Protest Shooting

A Texas judge has denied a retrial for Daniel Perry, a U.S. Army sergeant who was convicted of killing an armed protester during an encounter at a Black Lives Matter protest in Austin, Texas, in 2020.

Perry was found guilty of murder last month after he fatally shot Garrett Foster—who had approached his car while openly carrying an AK-47-style rifle. Perry’s legal team quickly filed a motion for a retrial in the case, arguing they were denied the ability to present key evidence and that the jury was swayed by outside influences and other jury misconduct.

State District Judge Clifford Brown, who presided over the original trial, denied Perry’s retrial request after a brief hearing on Wednesday.

I have read commentary from others that said Texas does not allow the governor to pardon anyone unless they are recommended by the pardon and parole board.

The governor has said that as soon as he can legally pardon Perry, he will do so.

If what I have read is true, I believe I would hold my fire on the Texas Governor until he has had a chance to comply with Texas law.

Of course this asshole would deny him a retrial. He was railroaded into a guilty verdict.

The judge and prosecutor(s) should be on Death Row, IMO.

Never, ever call the cops. Someone tries to break into your house and you defend yourself, bury the body, wash off the porch, and turn out the lights.

I thought this had to automatically be heard by a different judge. Especially since he had made the ruling that excluded evidence the defense had argued to use for their client.

Where is Gov. Abbot on this issue?

He said he's working on it. It will probably happen about the same time that Kevin McCarthy releases all the January 6th video.

Reality is the blind man saw this coming 8 miles away and is wondering why the board that Abbott appointed did not have a document to be signed.
