Judge Juan Merchan’s Donations to Democrats Could Be Grounds for Ethics Investigation

Judge Juan Merchan, who is overseeing former President Donald Trump’s case in Manhattan, violated New York’s Code of Judicial Conduct by making three donations to Democrats in 2020, which could be grounds for an ethics investigation, according to several legal experts and former prosecutors.

Under Section 100.5 of the New York Code of Judicial Conduct, sitting judges cannot “directly or indirectly engage in any political activity.” Prohibited political activity includes “(h) soliciting funds for, paying an assessment to, or making a contribution to a political organization or candidate.”

The New York State Advisory Committee on Judicial Ethics’s yearly-updated handbook makes this clear, stating:

A sitting judge may not make political contributions at any time, even to a U.S. presidential candidate or to a federal congressional candidate outside of New York State (Opinion 11-146; 22 NYCRR 100.5[A][1][h]).

It's going to be funny if he really DIDN'T make the donation, but is a victim of ActBlue taking money from a large (foreign?) donor and then splitting the donation into small amounts and just assigning them to random people on their mailing lists. Which narrative will they go with? $15.00 is a really small amount for a judge of his wealth to make to a Presidential candidate. Why would he risk being found out for such a small amount?

That was my first thought as well. However, Crowe does not have a case pending in from of Thomas at the moment so there is really no comparison.

The judge…….DA Bragg… when this is over their lives will be dramatically different as they try to piece them back together. Think Avanatti who was being proclaimed a Dem presidential candidate….

Is anyone investigating this? Since the O'Keefe video aired I have heard nothing but crickets. Total media blackout. Jim Jorden has not brought it up in his committee.

We caught the left with their money grubbing little peckers exposed for all to see and we do nothing.

The allegations are easily provable in a court of law and carry substantial criminal penalties. This rabbit hole in deep and the DNC is behind all the illegal activity.

Lots of states have elected judges who are therefore part of the political process. I don’t see how laws prohibiting their donations aren’t prohibiting their free speech rights.

That doesnt mean you can’t take their donations into account when you decide how to vote.

I was reading this early this morning, went to several articles, and was dismayed that they are pushing this when he apparently made three $10 donations. Seriously?!

I don't like the guy or his history but $10 donations are barely enough to be polite. And on top of that, they were apparently years ago.

Judges are expected to give up partisanship in order to remain impartial on the bench.

If they want to excercise the full spectrum of free speech they need to step down from the bench. They know this when they take the job.

Trump’s lawyers can use this to demand recusal.
