Raymond Zdunski argued that the LGBTQ training held by his employer, the Erie 2-Chautauqua-Cattaraugus Board of Cooperative Educational Services (BOCES), was “aimed at changing his religious beliefs about gender and sexuality” and was against his religion as a devout Christian, the Buffalo News reported.
The BOCES denied Zdunski’s request for religious accommodations.
In the lawsuit, Zdunski sought reinstatement, back pay and $10 million in damages, but District Judge Geoffrey W. Crawford dismissed the case a year ago.
On Monday, the Manhattan-based 2nd US Circuit Court of Appeals agreed with that decision and backed BOCES for terminating the Ashville, New York, man.
Both judges disagreed with Zdunski’s claims of “unlawful religious discrimination” and sided with BOCES. His former employer has maintained that Zdunski was fired after repeatedly refusing to complete the mandatory training program that was designed to facilitate a safe environment for students and staff.
“It just seems like the country is against the Christian way of life, and it’s for everything else,” Zdunski said in response. “We’re not allowed to practice our way of life but anyone else can, it seems.”
David O’Rourke, district superintendent and CEO of Erie 2-Chautauqua-Cattaraugus BOCES, reiterated that Zdunski was not fired because of his religious beliefs, but because he continuously refused to attend the mandatory training program.
“We agree with the decisions of both the United States District Court and the Court of Appeals, and remain committed to fostering a safe and supportive environment for all students and staff,” O’Rourke said.

After refusing to take part in the training session, Zdunski asked his bosses to schedule a mandatory training session concerning the persecution of Christians, according to court documents.

I pry would have attended the training if forced to, but I’d have on the biggest crucifix I could find and I’d bring a bottle of Holy Water that I’d sprinkle all around me every 15 minutes. There are ways to follow orders without really following them.

The courts have been infiltrated and are full on corrupt. This guy can try the USSC, but probably not promising.
I noticed recently that LGBTQ begins with Let’s Go Brandon.
I don’t believe there’s anything we can do other than treat
them respectfully. IMO < the odds are they won’t have to
treat the other employees respectfully, and will shoot
their mouth off by screaming any time they don’t get
exactly what they want.
I don’t believe it’s against Christianity to simply treat
them decently like you would anyone else. If we ask for
more than that, then we could be seen as problematic.
If they try to get us to sign a document that says they
have as much legitimacy in the social order as heterosexuals,
I’d have to refuse.
I’m not going to lie, or abdicate my beliefs to accommodate
them to that degree.

Anyone who went into the military in the 1960s had an anti-homo philosophy ground into us real well! Some of us were so sheltered in life we did not know such things existed! Every year after we had to go in for more anti homo training.
We served KP one day at the “outprocessing” barracks of those being kicked out.
We were warned of what we would see and were told...”You will see things many of you have never seen before! YOU WILL NOT LAUGH! You will not point! You will not stare! You will serve the food and that is all! IS THAT CLEAR!
And we said “SIR, YES SIR!” and we saw plenty!
It is a-hole judges like these that will be a big factor in a hot civil war if it comes. When people feel/think they cannot get justice because the judges and legal system are based on liberal wokism rather than the Constitution and law, they will eventually have had enough.
Gosh, before a real court, it sounds like an excellent 1-A case. BOCES is a government entity. It's what the Amendment was designed for, isn't it?
Meeting a friend for lunch in a different building on the corporate campus, the down elevator opens and SUDDENLY he grabs my arm and says I FORGOT the...! And drags me into a nearby washroom???
He looks around and checks the stalls like a drug dealer???
After he is certain we are alone, he asks if I noticed the Asian girl in the elevator, it is A MALE!!!

I later saw it in my building and quickly stepped into a restricted lab area for safety.

Well...he shoudl have gone to the sessions. Obviously it would not have gone smoothly for him. If they then retaliated by affecting what he could do at work, or suspended or fired him, then you go to court.
Otherwise they fall back on “we fired him for not going to employee training.”
You go to the training, do not back down and express your worldview, and if they are dumb enough to penalize you for your views, THEN you file the lawsuit.
Otherwise they have a technicality to hang your firing on.
I left a company that was sold to another company....The new CEO wanted us to promote climate change with our clients as well as environmental issues. hat was not what I had been hired for nor part of my responsibilities. I left and went to work for their competitor - sweet!
