Biden already admitted guilt — he’s just betting Garland doesn’t prosecute him, or Trump

There will be much to chew on as the criminal investigation of President Biden by the newly appointed special counsel, Robert Hur, unfolds. For now, my question is: Have we already, in effect, witnessed a guilty plea?

In announcing Hur’s appointment, Biden Attorney General Merrick Garland laid out the facts of the case that drove him to the decision. Biden, while he was a private citizen after the conclusion of his term as vice president, retained batches of classified information in unauthorized locations.

That is enough evidence of a federal penal offense to warrant a criminal investigation and potential prosecution — which is what’s necessary under Department of Justice regs to trigger the appointment of a special counsel.

The reaction to the special counsel appointment by Richard Sauber, the lawyer Biden has brought into the White House to help deal with investigations, was remarkable. He said the president was confident that the special counsel investigation would find that the documents in question were “inadvertently misplaced.”

That’s not a defense to a charge of mishandling classified information. It is tantamount to an admission of guilt. For conviction, federal law requires prosecutors to establish that the defendant was grossly negligent. There is no need to prove that an accused was trying to harm the United States; just that he was trusted with classified information and carelessly flouted the standards for safeguarding it.

So it appears that Biden is not challenging that the documents were classified, that the locations in which he kept them were not authorized, and that he failed to keep track of them. Why have an investigation when all the elements of the offense are established?

If the materials were actually classified, that were found in his house. That’s pretty much all that is required as evidence.

Well as some pundits may conclude, it could be the beginning of the end for Biden. Though maybe appointment of a special counsel would hamper a Congressional investigation... it certainly opens the door to other avenues of investigation. Burisma, Hunter, the blackmail of Ukrainian prosecutors, China dealings, what did he know and when did he know it about his son’s and brother’s business dealings etc. What is in those documents may be relevant, but not necessary for investigative purposes.

Watergate started out as a small time burglary. Though, Nixon had an opposition press whereas Biden has a media that is coffee klatch compliant. But by the time it came around to it, Nixon would have been lucky to have 10 acquittal votes in the Senate which is why he resigned.

I’d wager the clothes on my back that the Department of Just Us will find a way to charge DJT while announcing “the inquiry into the President’s matter is ongoing”.

Again, they have nothing on Pres Trump, but they can’t bring themselves to tell the world and their supporters that. Then first batch was found before the midterm elections and we’re just now finding out.

They’re going to treat this like off-setting penalties even though Pres Trump s clean.

I think charges will be pursued against both Biden and Trump.

Biden will be spoken to and will step down.
Trump will fight and win.

I’m not sure anyone really wants Kamala to be president for 10 years, but I think are setting up that scenario.

One thing to keep in mind, Trump was actually POTUS and as such had the authority to declassify anything he wanted.

Joey on the other had WAS NOT POTUS before 20 Jan 2021, so ANY document dated prior puts Joey in deep Sh!t.

Best option for Meritless Garland is to delay until 20 Jan 2025. Considering the amount of Damage Joey did to National Security, he should be HANGED!
