Jan 6 (Reuters) - A U.S. appeals court on Friday struck down a rule the Trump administration had adopted following a 2017 Las Vegas mass shooting that banned "bump stocks," devices that allow people to rapidly fire multiple rounds from semi-automatic guns.
In a 13-3 decision, the New Orleans-based 5th U.S. Circuit Court of Appeals said that despite "tremendous" public pressure to impose a ban, it was up to the U.S. Congress rather than the president to take action....
"The resulting circuit split should bring this decision to the U.S. Supreme Court's attention promptly and supply a suitable vehicle for deciding this issue once and for all," said Mark Chenoweth, the president of the New Civil Liberties Alliance, a conservative group that litigated the case.

The U.S. Court of Appeals for the Fifth Circuit handed down a 13-3 decision Friday striking down the regulatory gun control that banned bump stocks under former President Donald Trump. Reuters reported that the court intimated that actions on guns should be taken by Congress rather than the executive branch. Circuit Judge Jennifer Walker Elrod wrote the majority opinion for the Fifth Circuit and also opined that the framers of the bump stock ban did not provide “fair warning that possession of a non-mechanical bump stock is a crime.”

It's been posted at least once before, but it is a very important decision so no harm in posting it more.
The important part, is that the decision was not against bump stocks, specifically, but against a President issuing an executive order to enforce a prohibition on a firearm, or firearm accessory, which had never happened before Trump's action.
So the possibly of that happening again has hopefully been shut down, unless this is appealed to the USSC, which is not expected. Thanks.

Good riddance to a feel-good, knee-jerk reaction to tragedy.
one of the stupidest things trump ever did, hooray for common sense
What about all the records and database building they did on tracing down all the purchasers of bump stocks?
Crap...now I have sew my belt loops back on.......
Oh, I’m sure it’s safely stored, somewhere. Like the autopsy reports of the Las Vegas victims. I’m still not convinced that the weapon used wasn’t an M-240....7.62 caliber.
my slidefires came with approval from obamas atf, then one day I awoke and was a criminal by declaration from trump.
and hey I can still bumpfire with my body
:)
Only because Trump supported it. So it had to go. LOL.
Kinda close, he did fire .308 win via his ar-10.
All this means now is that Congress has an axe to grind when it comes to bump stocks.
What else will they add to the bill to ban when they go to redo this? The public wants it supposedly, and they can’t let an opportunity go like this to make a law banning something they hate, too good of an excuse now.
Just look for them to propose something stupid on page #3033 on the bill forbidding the sale of any type of action that could be used to allow for one.
The sound signature matched a -240.
Never worried my dad, he made one out of a bungee cord.
Sure, up from that height and because of the buildings, thinks sound weird. More weird, is that both dems and repubs don’t mention that shooting at all. Even dems don’t bring it up for their gun control cult.
Trump through regulation, not legislation, banned bump stocks.
