Charges dropped against Texas man that threw White Claw at Ted Cruz during Astros parade

A Texas grand jury has dropped the charges against a man accused of throwing unopened White Claw cans
at Sen. Ted Cruz during the Astros World Series parade in Houston last year. 

The 182nd District Court in Harris County dismissed the aggravated assault with a deadly weapon charge against Joseph Halm Arcidiacono on Friday, January 6
after a grand jury failed to find an indictment, according to a court filing reported by the Houston Chronicle.

 

Arcidiacono was arrested without incident at the parade in downtown Houston on November 7 after he reportedly ran up to the parade barrier wall, threw the two unopened cans and ran away.
Cruz, who was standing in the back of a military vehicle and waving to attendees, was reportedly hit in the chest and neck. He reportedly did not need medical attention. 

Police said Arcidiacono was apprehended by another parade-watcher and told officers, “I know, I’m an idiot. I’m sorry,” while he was being detained.
He was booked into the Harris County jail and released on a $40,000 bond.

They have it on video but the Grand Jury failed to indict.
Ted Cruz being a Republican is probably their excuse.

Cruz tweeted that the guy had a noodle for an arm.

If they bounced off of Ted Cruz, without noticeable effect, it might be hard to make aggravated assault.

Simple assault should be easy.

Prosecutors can over-charge a case, and gets the guy off scot free.

Just another example of selective enforcement.

I’d say the venue (location) had more to do with it than over charging. The charge was a just charge, and it was just lucky that he did not actual damage, as was Cruz.

Didn’t know you could assault anyone, particularly a sitting senator and get immunity

For those not old enough to remember, in 1963 there was no Federal law against shooting the President. Oswald was charged with murder under Texas law.
