Sen. Cardin: ‘Those Who Espouse Hate’ Are ‘Not Protected Under the First Amendment’

During a hearing on anti-semitism today, Senator Ben Cardin (D-Md.) claimed that those who “espouse hate” are not protected under the First Amendment, and called for the federal government to be “more aggressive” in its efforts to combat hateful rhetoric.

Senator Cardin serves as the Chair of the Commission on Security and Cooperation in Europe (OSCE), which is also referred to as the Helsinki Commission. […]

On Dec. 13, the Helsinki Commission held a hearing entitled, “The Alarming Rise of Anti-Semitism and Its Threat to Democracy.”

During the hearing, Cardin stated, “If you espouse hate, if you espouse violence, you’re not protected under the First Amendment.”

“So I think we can be more aggressive in the way that we handle that type of use of the internet,” he added. “We know that Europe has done things, I think that we can learn from each other.” […]

Senator Cardin’s remark drew a response from the Foundation for Individual Rights and Expression (FIRE), a First Amendment advocacy group. FIRE retweeted a clip of the senator’s comments with the statement, “there is no ‘hate speech’ exception to the First Amendment.”

FIRE also included a link to their website where it explains that the “First Amendment recognizes that the government cannot regulate ‘hate speech’ without inevitably silencing the dissent and dialogue that democracy requires.” …

What to you suppose he means by that?

What would you have to do to “espouse hate”? And whatever it is, it most certainly is protected by the First Amendment.

Look to your own office Cardin.

I called to ask why Cardin would vote for a judge who was soft on pedophiles for SCOTUS. The little dork who answered the phone said “Oh God” and hung up on me, then blocked my number.

I sent Cardin a letter demanding an apology, which of course was ignored.

Cardin is the hater.

With that fact front-and-center in all they do, nobody should be surprised by Cardin’s erroneous claim.

How can anyone become a senator and not understand the First Amendment? The First Amendment is short, clear, concise. It is not 4300 pages of congress generated diarrhea.

That's right, but most people have never actually read it or any of the Constitution for that matter. Instead, they rely on what they've been told—they have Constitutional rights leading them to say things like, "My First Amendment right to free speech..." and "Under the First Amendment, I have the right to free speech..."

No question this has been done deliberately to convince people that their rights come from the Constitution which makes it easy to take them away. To combat this, I came up with a short true-false question to wake people up.

True or False: The First Amendment grants us the right to free speech.
Most people quickly answer true, though the smarter ones recognize there might be iocaine powder in that question because of how easy it seems. They will waver a bit, but then reluctantly say true. When I counter, "False!" they all protest to which I say, "LIU. Look it up." Some do and now see it, others do and ask what's the difference. Either way, there's hope for them because they actually read it or at least asked about it. The ones who don't remain in ignorance. Not much you can do there.

Yep, just look at Europe where if you post you like homos on social media they arrest you, if you pray outside abortion clinics that is hateful and you will be arrested, if you dissent against the govt it’s violent speech. This is a supremely bad idea. Free speech is free speech

Another living example of why we need to repeal the 17th Amendment.

With the 17th Amendment gone this sort of demagogic appeal wouldn’t happen! State legislatures couldn’t do worse!
