The Supreme Court sided with a group of Republican states asking that the Title 42 immigration policy remain in place until the court can hear the full arguments from the litigants.
The ruling was issued Tuesday afternoon after a vote of five to four, with Justice Neil Gorsuch siding with the liberal wing.
The lawsuit was filed by Republican attorneys general from 19 states, led by Texas, that were protesting the end of the Trump era policy on the basis that it would result in a massive wave of illegal crossings at the border.
Title 42 has been called the "Remain in Mexico" policy as it allows the U.S. government to deport migrants who are applying for asylum to Mexico rather than allow them to remain the U.S. while their applications are processed. Critics say that migrants whose applications are rejected often ignore orders from law enforcement and stay in the U.S. illegally.

Gorsuch...Not sure of his thinking except that there arew more likely than not other immigration laws that should stop this “free entry” into our country. I’m thinking of the “Remain in Mexico” policy. What happened to that??
A vote with the liberals by Gorsuch did NOTHING to change either the ruling or the continuance of the practice. What it DID do was put his dessenting opinion on the record.

In a world envisioned by the Founders, the SCOTUS would be apolitical. But this is no longer that world and SCOTUS has never been that in MY lifetime. Hopefully his opinion can give it a nudge in that direction. His vote ln this issue has no import.
i believe Gorsuch is reprimanding Congress/Pres for punting this to Court when it should be handled by policy/legislation. it’s not up to Court to make policy.

Title 42 was intended for chi-com 19, and it is over.
Title 42 should be gone, regardless of the small amount of illegals it keeps in Mexico for a few more days/weeks.

Title 42 was started by the Trump Administration to deal with Covid, if Covid is no longer an issue, then why have an emergency measure to deal with it.
It’s a disgrace what’s happening on the border, we have laws to stop the invasion, we don’t need title 42, except as we all know the laws are being ignored.
Finally, even if Title 42 were to stay in place, does anyone think the Biden Administration would follow the law and enforce it ??
A guest on Steve Bannon’s War Room yesterday was making the point, it doesn’t really matter what the Supreme Court decides, the Biden Administration has been ignoring Title 42 anyway, by over time letting more and more people into the country.
The only thing holding Title 42 in place is the Biden Administration building up enough capacity to handle the flood of illegals that will come when it expires, as soon as the capacity is increased then Title 42 will end.

I agree with his logic. Congress and the Executive Branch are assigned the responsibility to propose laws to deal with issues as long as they are deemed issues. When the Covid temporary ‘emergency’ was declared over, then Congress should either establish new legislation if needed, or not, if it is not needed. The SC should not be in a position to carry on ‘temporary’ measures from previous administrations, but let Congress and the Executive branches do their jobs. We have all said we are not for ‘legislating from the bench’, but that is exactly what they are doing in this case. I would appreciate the opinion of legal scholars on this forum.

Yep. Title 42 relates to health emergencies. Trump enforced Title 42 in response to Covid.
Gorsuch said there is no longer any Covid emergency. Gorsuch stated that using Title 42 to try and solve the border crisis is the wrong approach, there need to be laws, and laws need to be enforced, to protect the border. I think he’s right.

This statement from Gorsuch clearly spells out the difference between a conservative and a liberal view. Ruth Ginsburg was known to defiantly assert that “Of course the Court makes policy. We do it all the time.”
