Did The FBI Violate The First Amendment When It Colluded With Twitter?

The FBI may have violated the First Amendment rights of Twitter users when it flagged accounts for the social media platform to review, several legal experts told the Daily Caller News Foundation.

Twitter became an “agent of the government” when it worked with the FBI to silence specific accounts at the agency’s request, Hans von Spakovsky, manager of the Heritage Foundation’s Election Law Reform Initiative and a senior legal fellow, told the DCNF.

Ari Cohn, free speech counsel at TechFreedom, told the DCNF that while the findings of the Twitter Files were “interesting,” he doesn’t believe there are “many legal conclusions to draw from it.”

The FBI has repeatedly flagged Twitter accounts for the social media platform to review and censor over the last few years, raising questions as to whether the agency violated the First Amendment rights of Twitter users, legal experts told the Daily Caller News Foundation.

The Twitter Files, a series of revelations by several journalists based on internal Twitter communications, revealed that FBI agents colluded with Twitter executives to censor users and suppress information, while the agency paid Twitter $3.5 million to compensate them for their time processing the FBI’s requests. This partnership raises questions as to whether the FBI may have violated user’s constitutional rights, legal experts told the DCNF, with some arguing the agency’s involvement in Twitter censorship constitutes a First Amendment violation. Aaron Terr, director of public advocacy at the Foundation for Individual Rights and Expression (FIRE), told the DCNF that users deserve to know the extent of how the government communicated with Twitter and that it could raise possible “First Amendment issues, although it could be tricky to prove.”

I would answer, the House of Representatives has the power of the purse, and Republicans should hold hearings ASAP. The FBI and intel agencies can be held responsible for their actions. They can be made to suffer, as they should be. Likewise, the institutions can be torn down (as JFK wanted to do to the CIA), and as many have wanted to do to the FBI. The DHS should be purged. If the Republicans in Congress are unwilling to tackle seriously this problem, then there is recourse. 1854 and the creation of the Republican Party is a guideline of what can result when a political party no longer meets the needs of its constituents.

Of course the fbi broke the law but it only hurt republicans so that means nothing will happen to anyone at the fbi.

It is way beyond a violation of the first amendment. The alphabet agencies are participating in a “Color Revolution” (Hope the spelling is correct.) With designs to destroy the United States. I call it Treason.

Like all of the Constitutional “government may not...” restrictions the Constitution doesn’t provide criminal penalties for this crime.

We need a constitutional amendment which sets out harsh penalties for government entities and employees who violate the Constitution. Congress could create laws, but laws are easily changed.

Yes. Congress funds the FBI, therefore falls under the 1st Amendment freedom of speech violation and should be defunded in total.

They will argue that since the FBI is not congress, or even constitutional, that they are exempt from violating the Bill of Rights. And by threatening like Schiffhead, “if you don’t censor what we don’t like we might have to do something about it” they can claim they didn’t “order” Twitter or big tech to censor anything. And an Obama judge will agree.

They didn’t just “collude” with Twitter. The federal government leaned on Twitter to do things that they, the federal government, could not.

This has been held by courts over and over again to be State Action.

The government, which has massive regulatory and oversight powers cannot lean on private companies as a means of getting around restrictions on government power in the constitution.

There needs to be consequences in the form of a massive class action lawsuit and mass firings of government employees involved.

I don't know if they violated the first amendment, but it's not like they killed about 25 little kids by burning them alive or shot some mom in the head while holding her baby after killing her 14 year old son.

The vast majority of the FBI are just amazing and outstanding law enforcement professionals with just a few bad apples giving them bad PR.... right?
