Jan. 6 committee’s referrals may ‘stiffen the spine’ of prosecutors

Plans from the House Jan. 6 committee to imminently release its list of criminal referrals is raising questions over how far the panel will go in implicating former President Trump and his allies in a plot that culminated in last year’s deadly attack on the Capitol.

Chairman Bennie Thompson (D-Miss.) told reporters Tuesday that the committee had come to a “general agreement” to send criminal referrals to the Justice Department.

It’s a move that would allow the panel to put a finer point on its more than yearlong investigation, naming names and detailing specific statutes that were violated in an effort they have repeatedly said was a lawless campaign to block the peaceful transfer of power.

And while it would still be up to the Justice Department to act on the recommendations, it could put pressure on a department that, at least publicly, has trailed the committee in its own review of the Capitol riot.

“They stiffen the spine of state and federal prosecutors by encouraging them to act,” Norm Eisen, counsel for Democrats in Trump’s first impeachment, said of the referrals on a call with reporters.

Legal experts have for some time argued there are a number of statutes that could be used for a possible Trump prosecution, including conspiracy to defraud the U.S.

Unless among those names are Pelosi, Schumer, McConnell, Schitt, Ratskin, Wray, Bowser, and others, their list is rather meaningless.

2 of the \protesters\ (”attackers”) died at the hands of the Capitol Police who were defending the building.

The ONLY deaths that day.

I sound like a broken record, but I would move to prevent this “criminal referral” as it is not one of the “legislative powers herein granted” by Article I and it also lacks a specific legislative purpose, which is required for hearings with subpoena power to be conducted in the first place.

Congress is NOT a Grand Jury. Congress MAY NOT, even by implication, accuse citizens of crimes (other than contempt of Congress). And they CERTAINLY cannot do these things “to stiffen the spines of prosecutors”, who don’t work for them, don’t report to them, and are the ones who at least have proper authority (even if misused, as in these cases) to investigate crimes.

Totally Agree. While their official legislative “justification” for the committee is legislation for “Capitol Security”, they have never focused on that and the vast majority of their witch hunt questioning was and is ultra vires. It has, in reality, been transformed by the leftists into an “Attainder” committee, with the constructive purpose of legislating a CONSTITUTIONALLY PROHIBITED BILL OF ATTAINDER.

That’s going to be interesting.

Say they send over referrals. DOJ will run with it.

Then comes Discovery, to include emails, an other communications and video.

Then calling people to testify.

It’ll be interesting to see how that all plays out.

I’m thinking Pelosi says something like…I didn’t ignore your offer for help.

Then they drop the emails where she turns down the help.

Some well known Rat Party hack (can't recall which one) was recently asked what would happen if GOP Committee Chairmen started issuing subpoenas. He responded with "we'll have to examine the legitimacy of those subpoenas".

That's code for "no way will any such subpoena be obeyed".

And there can be no doubt that *nothing* will happen to any Rat Party co-conspirator who ignores a subpoena.
