Appeals court halts special master review of documents seized at Mar-a-Lago in major defeat for Trump

In a major defeat for former President Donald Trump, a federal appeals court on Thursday halted a third-party review of documents seized from his Mar-a-Lago estate.

The ruling removes a major obstacle to the Justice Department’s investigation into the mishandling of government records from Trump’s time in the White House.

In a ruling on Thursday, the 11th US Circuit Court of Appeals reversed a lower court’s order appointing a so-called special master to sort through thousands of documents found at Trump’s home to determine what should be off limits to investigators.

“The law is clear,” the appeals court wrote. “We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant. Nor can we write a rule that allows only former presidents to do so.”

"The panel included Judge William H. Pryor, the former attorney general of Alabama, who was nominated to the bench by President George W. Bush. The other two judges on the panel, Andrew L. Brasher and Britt C. Grant, are Trump nominees."

Now an appeal to the full circuit and then to the Supreme Court. This decision needs to be overturned, but the US is slowky dying by lawsuits.

The Court cite a case from 1794 (way too old to be relevant) and a case named Cobbledick (obviously requested by Stormy Daniels to troll Trump)

No you stupid twits - the law is clear that a citizen have priority over the government, especially when the government has proven itself corrupted and taking punitive actions and selective law enforcement.

I’m confused...did the DOJ remove “thousands of documents”

You people are pissing up a rope thinking "ah, Trump's-In-The-Noose-Now #4199".

There are far, far, far too many key players on both sides of the aisle that do NOT want the Unitary Executive shackled in any way, shape or form.

When Bushes and McCrisis aided Cankles and Obama in the Russia Hoax, Poppy (don't forget, Poppy did not croak until 2 years into Trump's presidency) extracted a promise that their goal was to cripple President Trump, not remove him.

And then Nanzi nearly broke that deal.

But actually removing Trump would have set precedent for removing a future Unitary Executive. That would be, in Dana-does-Bush: "Bad, it's bad!".

As declassification has very little stare decisis as a matter of law, there have been a handful of papers speculating what any President's powers are in this regard, and almost all of them printed before this raid, land squarely on the side of Executive Privilege.

But the key here is SCOTUS, and this SCOTUS can't get enough Unitary Executive (if not so much Executive Privilege), Roberts will still thread the needle in favor of Trump.

Why? AGAIN, because failure to do so will set precedent for prosecuting a future -- or perhaps even a retired or soon-to-be retired Democrat/Socialist ex-President."

Right now, this very moment, thousands if not a million Classified documents from the Obama Administration are languishing in Chicago, in a year-to-year lease in a non-secure building from a failing company (Transformco, literally the glue holding the ashes of Sears together), in an easily-accessible suburban location, likely behind nothing more than a single deadbolt on the interior glass doors.

Think about that.

If the original judge's ruling stood every drug dealer, thief or white collar criminal served with a legal search warrant could prevent law enforcement from examining what they seized during the search.

The original order installing the special master was beyond radical.

Probably not allowed to go public, but they can leak it and nothing will be done.

However, this sets a precedence that the GOP if they had the balls. Can no look at Biden’s entire family taxes since he was elected. And then connect the dots. And leak them as well.
