Kroger to Pay $180,000 for Firing Christian Employees Who Opposed LGBT Rainbow

Kroger has agreed to pay $180,000 to settle a lawsuit that involved two employees who say they were fired for refusing to wear LGBT-themed aprons due to their religious beliefs.

The lawsuit was filed on behalf of the women by the U.S. Equal Employment Opportunity Commission (EEOC) in the final months of the Trump administration. The EEOC is a bipartisan commission that includes appointees of both President Biden and former President Donald Trump.

According to the suit, a Conway, Ark., grocery store “engaged in religious discrimination when it disciplined and ultimately fired the employees for refusing to wear an apron with the company’s ‘Our Promise’ symbol because they believed it represented support for the LGBTQ+ community,” an EEOC news release said.

Kroger denies the allegations.

Lawyers will probably get half.

Used to be that in Los Angeles, lawyers typically got 33 1/3% if there's a settlement, and 40% if it goes to trial. Might still be the case.

Don't ask me how I know.

“It should not be limited to “religious” reasons. It should be sufficient that you don’t want to be forced to display something with which you personally disagree as a condition of employment. I’d feel the same way if a store or business made me wear ANY political statement.

Imagine if they forced you to wear a BLM pin, an islamic crescent ribbon, a DNC badge, or a Christian cross! It is totally inappropriate for any business to require you to wear any of these things no matter what religion you are.”

Hard to believe that was disclosed. Usually EEOC settlements require a Non-Disclosure Agreement that invalidates the settlement if revealed. I know this. Big corporations don’t like to look bad.

"One woman “offered to wear the apron with the emblem covered, and the other offered to wear a different apron without the emblem, but the company made no attempt to accommodate their requests,” the EEOC said.

When the women “still refused to wear the apron with the emblem visible,” the EEOC said, Kroger “retaliated against them by disciplining and ultimately discharging them.”

Extremely well-played. Dream clients. Nice payday all around. Now where is their suit against the Teamsters for failing to back their objection?

Actually political speech is not protected by the statute.

A company can fire all the Democrats based on them being untrustworthy, for example.

Religion is the way to go here.

Why? This is a settlement not a jury award. The case has a prefix of “20”, indicating that the conduct complained of may have occurred around 2019, when the Arkansas minimum wage was $9.25. So that’s more or less two years wages if one earns minimum and works full time. That seems like a pretty good settlement, with the consent decree on top of that

No appeal from a settlement agreement. That's the tradeoff.

Settlement for a lesser amount, in exchange for no appeal.
