Former Attorney General Bill Barr said Friday on PBS’s “Firing Line” that the Department of Justice seems to “have the basis for legitimately indicting” former President Donald Trump.
Partial transcript as follows:
BARR: If a former president commits a crime, you know, especially a serious crime, they should be indicted for it. If the Department of Justice can show that these were indeed very sensitive documents, which I think they probably were, and also show that the president consciously was involved in misleading the department, deceiving the government, and playing games after he had received the subpoena for the documents, those are serious charges. That’s serious.

That’s a good synopsis of the situation.
Another aspect of this dilemma is the fact that this massive unaccountable bureaucracy is largely an Executive Branch problem, yet the other two Branches do not let the President deal with it.
A President’s key appointments - within his own Executive Branch - must be confirmed by the Legislative Branch - thus crippling his authority to hold his own administration accountable!
This cannot possibly be what the Founders intended for the Separation of Powers doctrine embodied in the Constitution.
Yet, if a President challenges an overreaching Legislature, the Judicial Branch steps in to arbitrate and almost invariably sides with the Legislature.
Somehow, by electing better Senators, or appointing better SC Justices, or SOMETHING - we need to restore the proper balance of power between the three Branches, so that a President elected to drain his own swamp has the power to do so.
Very good analysis, but I support a different cure.
We need to end the Imperial Presidency. Go back to the pre-FDR system where congress was far more powerful than the presidency.
Each federal department should get strict budgets and priorities from congress. The executive branch should only be tasked with implementing congress’ vision.

You are right to look at FDR’s Imperial Presidency as the point where it all went wrong. FDR built a massive permanent bureaucracy of unelected officials, granting them the power to reward or punish elected politicians via regulatory abuse.
But since then, the problem has not been a long line of Imperial Presidents - FDR was the last one. What we’ve had ever since is an Imperial Bureaucracy - a deep state - unaccountable to whoever happens to be President.
Some argue that Obama was another so-called Imperial President - because he was able to advance his progressive agenda through executive orders, and the other Branches did not stop him.
But I think Obama’s power was only in appearance - the truth is that the Imperial Deep State Bureaucracy has a progressive agenda - and any POTUS -like Obama - who goes along with that progressive agenda will be perceived to be powerful as well - like flying with the wind rather than against it.
It’s the power of the Deep State that needs to be curbed, not the power of the Presidency.
