Federal Court Blocks Biden’s Student Loan Forgiveness Nationwide

The U.S. Eighth Circuit Court of Appeals ordered a nationwide injunction pending appeal against President Joe Biden’s student loan debt forgiveness program Monday, adding to previous legal action blocking the plan.

The program seeks to forgive $10,000 in federal student loan debt for individuals with incomes under $125,000 and up to $20,000 for Pell Grant recipients, with the Biden administration claiming it had the authority to institute the program under the HEROES Act of 2003 and an emergency situation sparked by the COVID-19 pandemic. Nebraska, Missouri, Arkansas, Iowa, Kansas and South Carolina had filed a lawsuit against the Biden administration in late September over the program, and the court issued a stay on the debt cancellation last month before granting an emergency motion for the injunction Monday.

“We conclude that, at this stage of the litigation, an injunction limited to the plaintiff States, or even more broadly to student loans affecting the States, would be impractical and would fail to provide complete relief to the plaintiffs,” the latest court order said.

“The injunction will remain in effect until further order of this court or the Supreme Court of the United States,” a three-judge panel of the court said.

I just wish they would modify the interest from compound daily to simple interest.

I owed $1900.00 on my student loan, paid 115.00/ mo. After 5 years, my balance was up to SEVEN THOUSAND!!

That’s absolutely crazy.

What’s really sick is I only borrowed $1500.00 And the school took $300 of that. I paid on it for years but the balance only went up. At one point I gave them $1600 outright but the balance kept rising. Then life issued an impossible blow and I couldn’t pay.

Something does need to be done to modify the terms of the loan.
I agree, total forgiveness just because doesn’t cut it in the face of those of us who sacrificed to pay these loans, but they shouldn’t be a life sentence around the necks of the recipients of life’s cruelest moments. It’s unreasonable as it stands currently.

I read about this several days ago; don’t remember what publication it was. In the “comments” section, the idiots were furious and blamed the “Trump appointed” judge for it. I LOVED their anger.

I read the order at the link (Nebraska v Biden Eighth, Appellate Case: 22-3179 ). It was a three judge panel and the order refers to themselves as "we" throughout and there was not any reference to there being one of the three judges dissenting.
