Sure would be nice if some lawyers knew what “Bill of Attainder” and “Equal Protection under the Law” meant

Biden can no more forgive student debt than he can reward large breasted blondes from the public funds

The fact that this court shot it down means it concluded the plaintiffs had standing. If no standing, the court would never have rendered a decision on the merits.

This isn’t a bill of attainder case or an equal protection case. It’s a separation of powers case. Slow Joe does not have the power to do this.

“In this country, we are not ruled by an all-powerful executive with a pen and a phone.

Instead, we are ruled by a Constitution that provides for three distinct and independent branches of government…The Court is not blind to the current political division in our country.

But it is fundamental to the survival of our Republic that the separation of powers as outlined in our Constitution be preserved. And having interpreted the HEROES Act, the Court holds that it does not provide ‘clear congressional authorization’ for the Program proposed by the Secretary.”

“The court has correctly ruled in favor of our motion and deemed the Biden student loan program illegal. The judge criticized the Biden Administration program, calling it ‘one of the largest exercises of legislative power without congressional authority in the history of the United States.’ This ruling protects the rule of law which requires all Americans to have their voices heard by their federal government,” Parker said.

Bill of attainder is a legal penalty issues to a group of people, without a court case. Like, oh say demanding all who’re people pay black people reparations. You are grouped and judged without charges, jury or recourse

Equal protection clause, in that those who voluntarily incurred debt, are given priority over everyone else; who get the bill for a debt they declined to take. That is not equal treasure

A bill of attainder (also known as an act of attainder or writ of attainder or bill of penalties) is an act of a legislature declaring a person, or a group of people, guilty of some crime, and punishing them, often without a trial. As with attainder resulting from the normal judicial process, the effect of such a bill is to nullify the targeted person's civil rights, most notably the right to own property (and thus pass it on to heirs), the right to a title of nobility, and, in at least the original usage, the right to life itself.

If the Biden administration appeals, the case will be heard by the 5th Circuit and the loser there may petition to have the case heard by the Supreme Court.

Biden's order has served its purpose, so who knows what will happen.
