UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF TEXAS FORT WORTH DIVISION MYRA BROWN, ET AL., Plaintiffs, V. U.S. DEPARTMENT OF EDUCATION, ET AL., Defendants. No. 4:22-ev-0908-P ORDER The Constitution vests "all legislative powers" in Congress. This power, however, can be delegated to the executive branch. But if the executive branch seeks to use that delegated power to create a law of vast economic and political significance, it must have clear congressional authorization. If not, the executive branch unconstitutionally exercises "legislative powers" vested in Congress. In this case, the HEROES Act-a law to provide loan assistance to military personnel defending our nation -does not provide the executive branch clear congressional authorization to create a $400 billion student loan forgiveness program. The Program is thus an unconstitutional exercise

Well there is still time for the democrats to ram this though the legislative branch and onto Biden. I would not be surprised if they do it.

Trump’s immediate action in nominating conservative constitutional judges once he was elected was one of the shining points of his administration. Those nominations will make a difference for years to come.

I think SCOTUS will say the same. This is a sound legal decision and if SCOTUS were to reverse this it would effectively make the President into a monarch who could spend money at will absent authorization from congress.

From what I understand, even if what Biden did was legally wrong nobody has standing to sue due to lack of a legal tort. Roberts is probably going to use this weasel route to vacate the injunction and not hear the case.

I don’t think the left cares that much now. This was a gambit to help get votes during the election. Now that it is over, does not matter if this gets overruled...
