School Superintendent Said Thin Blue Line Flag Was No Longer Allowed On Sideline. High School Football Players Displayed It Anyway.

A California district superintendent recently announced that a high school football team was no longer allowed to display the Thin Blue Line at its games, but that didn’t stop Saugus High School players.

When most of the team ran onto the field Friday night, the tradition of the Thin Blue Line Flag was absent. Two players then came onto the field carrying an American flag and a Thin Blue Line flag, even after Superintendent Mike Kuhlman announced they weren’t allowed to show the flag supporting law enforcement

Kuhlman announced the decision to ban the team from displaying the flag without the Hart District School Board hearing the issue. The district reportedly received complaints about Saugus High School players carrying the flag onto the field before games because people found it divisive.

According to Kuhlman’s letter explaining the decision, the head football coach was the one who made the decision to stop the tradition of carrying the Thin Blue Line flag onto the field.

“Given that some individuals have expressed concern that they interpret the Thin Blue Line flag to be divisive, it occurred to (the coach) that it’s possible that some players on the team might not be entirely enthusiastic about a symbol that is being used to represent the entire team,” Kuhlman wrote

Does the thin blue line flag conform to 4 USC? Answer says NO! If we are going to support to the Popo then we need to follow the letter of the law and not break it arbitrarily to suit our needs. The only person who can adjust or alter the flag is the commander of the military forces which is the POTUS and by proclamation. How easy would it be to get that proclamation and just do it right? The problem is we have became a nation that stomps their feet when they don’t get their way. So point blank no matter how we feel the superintendent was correct under current USC be it his motives may have been against your desires to show support to the Popo.

A little bit of context might further clarify just how lame this bureaucrat is. Saugus is in the area generally referred to as “canyon country” in north LA county, and is home to an enormous number of LEO’s and Firefighters from a wide range of agencies.

There are guaranteed to be a substantial number of kids whose parents are cops or other first responders on the team and in the stands. And the parents, well, they’re at the game too.

So how deep, and how widespread do you think support for banning expressions of support for LE is going to be in Saugus, California? Maybe this will motivate some folks to get on that school board and straighten things out a bit.

So you are willing to break federal law to show support for the law? That makes you know better than the Libturds which is the point of my post. Petition the POTUS for a proclamation authorizing the thin blue line flag is the proper way to do it, not I want it and I am going to do it. If we are going to get this country back we need to follow the laws of the land and use them to our advantage.

Its intent is to be in the image if an American flag period. That makes 4 USC applicable like it or lump it. When are people going to wake up and understand there is a process to get images like the thin blue line flag approved? As usual people do not want to go through the process and just get what they want. So breaking the law to make you feel good is no different than the rioters that tore Portland to shreds and got by with it.

Think logically and you can see my point. Do I support the Popo? Sure do because with out the Popo we have anarchy in the streets. All I am pointing out is the hypocrisy when people decry one thing and condone another because it makes them feel better.

Violation of the Flag Code originally contained a criminal penalty of a fine and up to one year in jail. But in 1990, in U.S. v. Eichman, addressing flag burning, the Supreme Court invalidated the federal law against flag desecration as violating free speech under the First Amendment. The current amended U.S. Flag Code has no penalty provision and is considered advisory flag etiquette.

When I lived in the area SAUGUS and NEWHALL were famous for MUNITIONS MANUFACTORING; HALAFAX/BERMITE were great places to work.

You are correct that 4 USC has no civil penalties nor will you find them in most USC’s but none the less it is in violation of the USC. You find civil penalties elsewhere in the laws other than the USC. Are we no better than the BLM or Antifa when we just arbitrarily disregard the USC yet bemoan the BLM and Antifa? That is the problem I see where people just do what they wish and complain about someone else when they do not like what they are doing.

As I have stated 4 USC can be altered through proclamation by the POTUS. What is so hard to understand that for us to be better than the criminals we cry about we must take the lead and do the right thing by obeying the laws of the land or petition the POTUS to issue a proclamation authorizing the display of the TBL flag. To have the upper hand we must be on the up and up.

4 USC is a statute but it has no enforcement power with respect to flag desecration because regulation related to flag desecration is a prima facie violation of the First Amendment. (This question was answered by the SCOTUS.)

As far as flag desecration goes, in 4 USC there is nothing to follow or disregard, it is dead ink.

As you mention, a President and/or Congress could modify or remove the statute, but why would they bother. It has no power and deleting it completely or amending it would inflame politics one way or another.

Thinking about it causally, it may be unlawful to add a carve out for TBL flags because it would be the government promoting speech/expression associated with one political viewpoint while omitting others.

However, expressing one’s opinion regarding the appropriateness or propriety of a flag design that incorporates features from the US Flag is protected.

And, I do generally agree with you here — I am not a fan of vanity flags that are derivative of the US Flag. But I think most TBL flags are sufficiently distinguishable from the US Flag so there is no confusion as to whether it is an official symbol of the USA.

In the case of a public school banning the TBL flag, it is probably a first amendment violation, especially if the school allows other flags in addition the US Flag to be displayed at school or at school events.
