The New York state Supreme Court has reinstated all employees who were fired for not being vaccinated, ordering back pay and saying their rights had been violated.
The court found Monday that "being vaccinated does not prevent an individual from contracting or transmitting COVID-19." New York City Mayor Eric Adams claimed earlier this year that his administration would not rehire employees who had been fired over their vaccination status.
NYC alone fired roughly 1,400 employees for being unvaccinated earlier this year after the city adopted a vaccine mandate under former Mayor Bill de Blasio.

The result could be back pay for many.
Not sure that even the USSC could make the reinstatement apply to DOD Enlisted and Commissioned?

The New York courts have historically been pretty good, except for bad patches every now and then. The Court of Appeals was once the gold standard for trend-setting precedents.

Being vaccinated doesn’t prevent any vaccinated person catching or transmitting ANY disease. Not just covid.
The scope needs to be broader than just this one vaccine. The next vax mandate will be coming.
I thought it was a county supreme court.
If reinstatement becomes the rule, then, we can expect hundreds of billions more added to the deficit and national debt.
But, stupid decisions come with repercussions. Stupid people should never be allowed to make decisions for millions.
Nope, NY state supreme court, which is their parlance for an appellate court.
They were dealing with Dumblasio making these decisions. It was inevitable.

Hmmm, I got fired by MIT for not getting the booster (s). This could be like getting a 1 year paid sabbatical.
Can this ruling be appealed to another NY court?

Yes it’s VERY confusing. As to your question, of course NY will appeal this - to the highest levels, I’m sure within the state court system and likely beyond.
Remember, The “Supreme Court” in New York is the LOWEST court. The Court of Appeals is what most other states and the Feds call “The Supreme Court”.
The opinion was written by a Judge of Richmond County (Staten Island), NOT the whole state.
