Supreme Court’s Amy Coney Barrett declines to block Biden’s student loan relief

Conservative US Supreme Court Justice Amy Coney Barrett on Thursday declined to block President Joe Biden’s plan to forgive $400 billion in student loans less than a week after the White House began accepting applications for relief program.

Barrett, who is responsible for acting on emergency matters arising in Wisconsin, rejected a request from the state’s Brown County Taxpayers Association to halt the White House’s historic program.

The justice did not provide a reason for blocking the organization’s lawsuit. Barrett also did not ask Biden’s administration for a response to the group’s request or consult other justices before handing down the decision.

When Dems nominate a justice when they get through the hearing they are ALWAYS loyally Leftist all the way forever.

When a “conservative” is nominated, if they aren’t destroyed like Bork, they have to make a good show of acting moderate and saying they have no agenda to move America to the right.
But then most become wishy washy weaklings and some traitors (John G. Rogers,Jr.). Never reliably conservative. Except Clarence Thomas and Alito types.

But the last three who were put on the Supreme Court acted as they always had. Kavanaugh and Gorsuch were Anthony Kennedy disciples. They were always going to be moderate.

I am not impressed with ACB at all. She was an approved McConnell pick and an elitest. She is no way conservative! She will side with Roberts and the lefties before she sides with Thomas or Alito. Miss Junior League wants to send her kids to Sidwell Friends with the other snobs.

At least she is to the right of Kavanaugh and Gorsuch. She actually clerked for Scalia. Gorsuch and Kavanaugh are disciples of Anthony Kennedy, and they will slide to the left more and more.

Roberts is different. He actually had a solid track record as a Scalia or Thomas type judge.

Ya know, if Amy had given a good comprehensive reason for her decision, I might feel better about this.

As it stands now, I think Amy is an SOB.

And I have to admit that when she was nominated I thought she was a phony and a creep.

I don’t think you’re thinking about this logically. John Roberts has been a tremendous disappointment, but he was no David Suitor without a track record. He had a very strong track record in his time before The Supreme court. I don’t know what happened to him but it wasn’t like he was chosen based on not having a track record. Gorsuch and Kavanaugh were Anthony Kennedy disciples. So they weren’t going to be far left like Kagan but they were going to be a little bit left of center and probably a little bit left of Kennedy.

The private loan servicer companies deprived of these loans to collect on have standing per their contracts. Two out of every 5 loans will be wiped out with Biden’s credit plan and they will lose millions. MOHELA in Missouri is suing but it’s not at the Supreme Court yet. But Biden’s plan is illegal. The HEROES Act was meant for 9-11 era soldiers.

I can’t fully agree with you. Yes, Barrett seems to be somewhat “to the right of Kavanaugh”, but not “to the right of Gorsuch.”

Gorsuch often agrees with Thomas when other justices don’t. I would call him an elitist intellectual constitutionalist. He is not a religious conservative. He acts as an originalist unless it interferes with his strong feelings. He is weak on LGBT unless a party is a religious institution (He supports wide autonomy of religious institutions.). He often sides with Indian tribes. In criminal cases he believes that laws should be interpreted narrowly which is a legitmate constitutionalist view because it gives the government less power (Justice Alito, on the other hand, is extremely pro-law and order). However, he wrote an excellent originalist opinion explaining why death penalty isn’t cruel and unusual.

As far as Roberts is concerned, I remember that after he was nominated I read an opinion of a person who was apparently on the left side of the political spectrum that - from his point of view - a much worse candidate could have been picked. Roberts was called “a judicial minimalist”, which was supposed to mean that he was not an activist because he preferred narrow decisions. But, as we have seen, being a minimalist - preferring procedural “non-decision” decisions - is very different from being an originalist.

In general, I believe that one quality of potential candidates for a Supreme Court justice has been neglected. Those who come from humble, non-elite families are less likely “to grow” because they are less concerned about what the elite (these days almost uniformly progressive) will think about them. They also appreciate a vision of America as a land of opportunity for those who are willing to work hard much more.
