Lehigh County judge strikes down lawsuit demanding election drop boxes be monitored, limited to business hours

With Election Day less than three weeks away, a Lehigh County judge has rejected a lawsuit by four residents who demanded tighter restrictions on ballot drop boxes.

The plaintiffs, all Republicans, demanded the boxes at the government center in Allentown and other parts of the county be open only during “normal” business hours and be monitored in person to make sure voters drop only their own ballots, or ballots they have been authorized to drop.

In a ruling issued late Tuesday, Judge Thomas Capehart said evidence presented at hearings on the case showed in-person monitoring had not conclusively reduced third-party ballot dropping, but better education, publicity and signage had succeeded in doing so.

Additionally, in-person monitoring, “while seemingly innocuous, is more likely than not to have the unintended result of in-person intervention at the drop box sites and may unduly interfere with voters lawfully returning their ballots to the drop box.”

Capehart also said the county had made its case that it would be too difficult to hire and train drop box observers in such a short time, meaning the boxes, which many voters rely on, would be eliminated.

“With better and clearer information being provided to voters by the [county election board] and with this information being publicly disseminated to the electorate in a timely fashion, the integrity of mail-in voting via drop boxes in Lehigh County remains safe and secure,” the judge wrote.

He also said granting the suit’s demands at this late date is likely to create confusion and uncertainty around the election, further eroding the public’s confidence in the process. Mail-in ballots “have already been sent to voters with information designed to assist voters when voting by mail, and any changes to these instructions is unlikely to be timely or clear,” Capehart wrote.

video monitoring of drop boxes should be MANDATORY

How is that a problem? For anyone?

If they are not then the GOP should take it upon itself to have them monitored

Get some volunteers to watch them and record video. Or just park a car nearby with dashcam video

If a judge endorses it, then it must be legal . . . /sarc (as if I really needed this)

There should be a lawsuit with similar results for toll booths...

No excuse mail in ballots are unconstitutional in PA. The whole proce3ss is unconstitutional and any one elected under these rules is not a legitimate officeholder.

So much for...of the people, by the people, for the people.

Judges are out of control. But then again, that’s old news to everyone.

PERFECT Solution.
Record them, then go after the Judge if/when fraud is proved. Too bad there isn’t a way to hold the judge’s decision over his head like making him an accessory to FRAUD.

Translation: “Cheating is not only allowed. It’s encouraged.”

Our brilliant forefathers established 3 branches of government, executive, judiciary, legislative and also a watch dog via much protection of the media and free speech. The media has legal protection beyond that of normal citizens and this was wise.

This great constitution was written after a war with England in which the English had none of the above. They had a tyrant king George III. Tyrany can only be established in a free nation when all are corrupted.

1. Biden's executive branch. corrupt
2. The Judicary under Biden. corrupt
3. The Legislative under Biden. corrupt
4. The media by choice. Politically corrupt in extreme

They also gave us the second amendment to be used wisely.

“In a ruling issued late Tuesday, Judge Thomas Capehart said evidence presented at hearings on the case showed in-person monitoring had not conclusively reduced third-party ballot dropping, but better education, publicity and signage had succeeded in doing so.”

LOL! What evidence presented??!! Official statistical lies, evidence from republican heavy districts that would definitely show low 3rd party drop percentages, surveillance data from non-designated mule drop boxes, and invented democrat-paid-for responses from ‘expert’ testimony dissuading from and marginalizing the concerns? All misdirection! Of course it hadn’t reduced 3rd party ballot dropping in Dem heavy districts, because the entire purpose of installing drop-boxes was to provide 3rd party ballot mules a location to inconspicuously drop their ballots! The mules ONLY went to designated drop-boxes so that the criminal enterprise (the Democrats) could monitor and control exposure of the crime in case the surveillance data is questioned and/or subpoenaed. Typical response from the Dems would always be... “They were lost or accidentally erased/destroyed or stolen! Too bad, so sad. We tried to comply.”

This needs to be vigorously appealed to SCOTUS, if possible.

Since the government won’t monitor them, what is to stop someone from just stealing or destroying the dropboxes?

“it would be too difficult to hire and train drop box observers”

YOU LIE!!! What a disgrace. If that is the case drop boxes must be locked up after said business hours. BUT, they will leave the drop boxes unmonitored 24/7 and make it illegal for any citizen drop box monitor to watch them. And SURPRISE. All the drop boxes in strategic districts will be loaded with democrat votes at 5:01PM every night. Disgusting.

The cheating is baked in to the cake now.

I was thinking a similar thought. If security isnt provided, how confidant can the voter be that the ballot wont be destroyed by some looney?
