After bags of heart-shaped Valentine’s Day candy found inside a man’s car led to his arrest on a drug charge, he decided to sue police in New Jersey, according to a federal lawsuit.
Fernando Saint-Jean, of Massachusetts, says he was “falsely charged” with possession of MDMA/ecstasy after officers found the candy inside his car during a traffic stop in New Jersey, court documents state.
However, lab test results proved that the pastel-colored candy, commonly found in stores around Valentine’s Day, did not contain illegal substances more than two months after Palisades Interstate Parkway Police officers arrested Saint-Jean in May 2018, court documents state.
“After the heart-shaped objects were lab tested over two months later, the truth came out: they were just candies,” the appeals court’s opinion states. “Even with that knowledge, it still took nearly four additional months to drop the charges against the driver.”

Police state. “Feel” safe yet?
I bet to this day the cops swear it was a dry run test with candy before the ACTUAL run with the dope, or something that crazy.

He’s looking for a sweet payout.
You have no heart!
“he’s looking for a sweet payout”. I think there should be some compensation for six months of illegal imprisonment. If you got locked up for six months, I’m sure you’d just laugh it off.
I abhor drugs and druggies.
I am particularly angry that a giant police state — which is commonly misused — has arisen because of the war on drugs.
That police state — as we see with routine abuses by the FBI and the like — is far more dangerous than druggies are to others.
We need to admit defeat and dismantle the police state and let idiots go die of drug overdoses. I just don’t care at this point.
It is case like this that should prompt the Supreme Court to Overturn their Legal Fiction they created out of thin air called “qualified immunity”
Executing drug traffickers works for me, too.
I agree. The additional 4 months they drug their feet is especially egregious.
Incredible... If they had any doubt at all this should have never happened. Self proclaimed Geniuses again.
The problem with that is; more druggies means more crime to pay for those drugs. If they could just stay home and die then, OK, but, it just won't work that way.
Along with the one called “Absolute immunity”.
I like #5 of the Code of Hammurabi:
5. If a judge try a case, reach a decision, and present his judgment in writing; if later error shall appear in his decision, and it be through his own fault, then he shall pay twelve times the fine set by him in the case, and he shall be publicly removed from the judge’s bench, and never again shall he sit there to render judgement.

“The officers filed a notice of appeal to challenge the District Court’s denial of qualified immunity under federal and New Jersey law. But before the officers appealed, the driver had amended his complaint,” the court wrote. “Due to that prior amendment, the District Court’s order was not final when the officers appealed.”
This is even more incredible... They appealed it? lol
What has the drug war done to reduce drug addiction?
Take away all restrictions and find out.
So in addition to guns and cash being effectively illegal the cops are now cracking down on candy.
Now they can do civil asset forfeiture on $100,000 bars because they’re cash AND candy!!!!
