Supreme Court Could Overturn Gun Control Brought In After Vegas Shooting

The U.S. Supreme Court could be poised to strike down a ban on bump stocks introduced following the 2017 mass shooting in Las Vegas that left 58 people dead.

The justices may be preparing to hear two lawsuits challenging the bump stock ban, which was introduced by then President Donald Trump in 2018, as the new judicial term begins on October 3.

A bump stock is a firearm attachment that allows a semi-automatic weapon to shoot almost as fast as a machine gun does. A bump stock was used by the Las Vegas shooter.

Trump instructed the Department of Justice (DOJ) to take action to regulate bump stocks and the department redefined them as machine guns, meaning they are illegal under already existing law.

Two lawsuits challenging the ban - W. Clark Aposhian v. Attorney General Merrick and Gun Owners of America v. Garland - were due to be discussed by the nine justices at their conference on September 28.

The cases center on whether the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) was in error when it defined bump stocks as machine guns under a 1986 law that bans machine guns. The ATF had not previously defined bump stocks in this way.

The Supreme Court has previously appeared reluctant to take up challenges to the bump stock ban and the justices have sent several Second Amendment cases back to the lower courts. They may wish to see how lower courts deal with the bump stock question before weighing in.

President Joe Biden's administration has also asked the Supreme Court not to hear the cases. The Supreme Court declined to hear a challenge to the ban in 2020 but Associate Justice Amy Coney Barrett has joined since, giving conservatives a 6-3 majority.

I think SCOTUS refused to hear the bump stock ban. There are better cases for them to build on recent reset of the 2nd amendment.

Rats. I didn’t see that. A friend had just sent this article. Since you can use multiple items to create a bump stock, they should’ve taken the case & over-ruled it. How can you regulate “something” that can only be defined by its use?

The Feds continue to lie about the Las Vegas shooting. They know there were more than one shooter and that they weren't using bump stocks.

The right of The People to keep and bear arms shall not be infringed.

Hat tip to Penn & Teller who point out that the Second Amendment doesn't say "The right of The Militia to keep and bear arms..."

Aren’t bump stocks inherently inaccurate? If so there are certainly better cases to concentrate on.

This where Trump lost me.
Pres. does not have the power to “Direct” an agency to “redefine” established legal definitions just to appease the anti-RKBA radicals.
If the “Law” is that fluid it is in fact not “Law” at all.
There are several other ways to achieve the same effect as the bump-fire stocks.
Look up “The shoe-string trick” for one.
The main difference in the bump-stock, which was ruled by ATF to be LEGAL per definition prior to the shooting, is that it allows for better aim.
Not that aim was relevant during the LV shooting spree due to distance and the tightly packed crowd.
Flame suit on.

From what I've heard and personally seen, very inaccurate tools to spray bullets, not it something unless just a couple feet away.

I never heard of or seen a bump stock until it became news. Then I've seen that you can use a large rubber band to accomplish the same.

I'll stick with my binary trigger.

Auto fire is inherently inaccurate and a waste of ammo.. This is why currently real assault rifles use burst fire rather than full auto. Full auto is better kept to crew served weapons. Even then they fire in short bursts to minimize ammo use and extend barrel life.

Unless you are facing human waves in Korea full auto fire is usually counter productive. You can use up your 200 round ammo supply in a couple of minutes if you aren’t careful.

Agreed. IIRC the State of New York enacted a number of horrible,unconstitutional,laws infringing upon 2nd Amendment rights a few days after last June's ruling.It's as if they had those laws ready to go in anticipation of losing that case.

Many states,almost all of them blue,still have blatantly unconstitutional laws on the books even after the SCOTUS ruling.

What would we do? This was something trump believed in, just like cove lockdowns. MAGA loves some gun control. This one was lived so much the NRA was virtually silent l. Gun owners of America were not.

The issue is not that bump stocks suck.

The issue is that BATF violated the law.

Laws that may be redefined on political whim are not really law at all, just the dictat of the moment.

Bump stocks actually cycle at a much slower rate than a machine gun.
