Archie Battersbee: Last-minute hearing to be held over treatment

The Court of Appeal is to hold a last-minute hearing in the case of Archie Battersbee - hours before doctors are due to withdraw life support.

The government asked judges to urgently consider a request from a United Nations committee to keep treating the 12-year-old while it examines the case.

The Court of Appeal hearing is scheduled for 11:00 BST - three hours before care is due to end at 14:00.

Archie was found unconscious at home in Southend, Essex, on 7 April.

He has never regained consciousness and his mother Hollie Dance said she believed he might have been taking part in an online challenge.

Archie, who is at Royal London Hospital in east London, is due to have his life support stopped on Monday afternoon.

Doctors at the Royal London Hospital, where Archie is being treated, have said that he is brain-stem dead and that it is in the child's best interest to stop treatment.

Last week, Appeal Court judges ruled that doctors could lawfully disconnect his ventilator.

It comes after two High Court judges agreed with doctors and said life support treatment could end.

Archie's family applied to the UN Committee on the Rights of Persons With Disabilities (UNRPD) to consider the case, arguing it had a protocol that allowed individuals and families to "make complaints about violations of disabled people's rights".

The committee requested that Archie's life support continued while it considered the application from his family - a request now granted by the government.

A legal "stay" to prevent treatment being withdrawn has also been put in place until 13:00 on Monday.

His parents are adamant for life support to continue and are distraught.

Doctors say nothing can be done

In the last decade we have had some big cases of the National Health Service in the UK putting children to death in similar situations.

I’m fed up with the NHS and the Fakeservative Party in the UK doing this stuff because it’s been on the watch of the Tories.

I’m wondering what Freepers think . It’s a tough one.

It's a very tough choice to make. I had to make it for my husband...self-inflicted GSW. Brain stem was dead. It was easy on one hand, it was obvious he didn't want to be here. It was incredibly hard on the other hand because we (2 sons, 2 DILs, 3 grands) desperately didn't want him to leave.

I decided, with their input, to let him go on his terms.

Gotta admit, there are many nights I wonder if I made the right choice. When I see him now, in my dreams, he assures me he's happy.

He is brain dead and continuing to treat him is pointless. As parents, they are understandably desperate to cling on to any hope that the doctors are wrong but it’s the job of objective people to assess the situation and make a decision based on the facts.

Just out of curiosity, would a medical insurance company keep paying out thousands upon thousands to keep someone alive that the consensus by doctors was that he was beyond hope?

I will point out that taking someone off a ventilator isn’t the same as euthanizing him or starving him to death. If a person with an untreatable medical condition can’t breathe on his own, it’s a sure sign that death is a “natural” result of the condition.

The big issue is not ‘should they pull the plug or not’.

The real issue is that the health authorities refuse to allow parents to move their comatose patients to other healthcare facilities, often out of country, to be treated elsewhere.

It has happened numerous times there.
