Behar: Trump Will Not Be Prosecuted — ‘There’s No Smoking Gun’

Joy Behar told her co-hosts Wednesday on ABC’s “The View” that she has not seen a “smoking gun” during the January 6 hearings, so she believes former President Donald Trump will not be prosecuted.

Behar said, “I don’t know. I mean, you know, there was a report today in The Washington Post by, what is her name? Carol Leonnig she broke the story, and Lester Holt said it could cause a disruption in the country, and Merrick Garland said, that’s not my problem. My problem is to bring people to justice if they’re guilty. Okay, good. On the other hand, they say it’s a very high bar to prosecute a sitting president or a former president. It’s never been done before. It’s a very, very high bar. But if Merrick Garland is saying no one is above the law, then what does the high bar mean? The whole thing is very confusing, and it makes me insecure about whether this will actually happen for Trump. The high bar, yes, and he’s definitely out to prove he did something wrong, but, again, they say that we’ve never seen this before. I don’t believe it. I don’t believe it.”

Co-host Sunny Hostin asked, “You don’t believe that he’ll be prosecuted?”

Behar said, “No, I don’t.”

Hostin said, “Even though I have been saying it for a couple of months, Joy?”

Behar said, “You know I have the highest esteem for you, my dear, and I believe you. But in my gut, I say to myself. He’s such a snake. He’ll find a way out of this.”

She continued, “When he says to the guy, Raffensperger, all I need is this many votes. That sounds bad, right?”

She added, “He could say, you know, maybe they were missing. I wanted to make sure they counted correctly. There’s

In their minds, they think they’re showing Trump’s “crimes” to the American public (i.e. swing voters) but they won’t dare allow anything to happen that might keep him out of the election.

They want Trump damaged but not so damaged that he can’t run for president because that would open up a whole different campaign environment.

Only the names would be changed. The smears and lies would be the same.

I think political crimes require political consequences not legal consequences.

In other words, if politicians commit political crimes, let We the People sort it via the ballot box.

The Democrats have been getting this wrong for years - trying to convict Trump of various political crimes was not their job. Actually putting Trump supporters behind bars was a grotesque abuse of power.

This was a huge mistake on the part of Democrats - We the People chose President Trump, and we do not appreciate the Democrats overstepping their authority and trying to reverse our decision. Criminalizing politics was something the Founders were determined to prevent, which is why impeachment and removal of a President is nearly impossible.

The Founders wanted choosing a President to be entirely up to We the People - and that means removing a President is entirely up to us too.

The 2024 election (if it’s fair) will decide who the next President is - not the DOJ, not Congress, not the Senate, not SCOTUS.

Congress, SCOTUS and the DOJ do have an important role in the Presidential selection process though: making sure elections are fair - and in 2020, they failed miserably.
