NEW ORLEANS (AP) — In a reversal for President Joe Biden, a federal appeals court in New Orleans on Monday agreed to reconsider its own April ruling that allowed the administration to require federal employees to be vaccinated against COVID-19.
The new order from the 5th U.S. Circuit Court of Appeals in New Orleans vacates an earlier ruling by a three-judge panel that upheld the mandate. The new order means a block on the mandate imposed in January by a Texas-based federal judge remains in effect, while the full court’s 17 judges take up the appeal.
Biden had issued an order Sept. 9 requiring that more than 3.5 million federal executive branch workers undergo vaccination, with no option to get regularly tested instead, unless they secured approved medical or religious exemptions.
U.S. District Judge Jeffrey Brown, who was appointed to the District Court for the Southern District of Texas by then-President Donald Trump, issued a nationwide injunction against the requirement in January. At the time, the White House said 98% of federal workers were already vaccinated.
The administration argued the Constitution gives the president, as the head of the federal workforce, the same authority as the CEO of a private corporation to require that employees be vaccinated.

Anyone left that has held out?
There is only one reason to go after that 2% of the federal workforce ... they plan to force vaccinate again.
but Joe is building a massive COVID vaccine plant so he can give everyone dozens of shots a year
My son. He’s a federal worker. He is not vaccinated.
yes, i know some
They are bound and determined they are going to start a new round of Covid. It’s common knowledge that the vaccines caused the variations, and now they want a new health “crisis,” to steal the midterms.
I have a medical exemption. DoD contractor. My doctor had no reservations in writing the exception. I forwarded to HR citing the need for a timely adjudication as I needed to decide whether to sign up for annual benefits in the sign-up window or initiate retirement. The exception was accepted, I signed up for another year. I'm not anxious to retire. I enjoy my job and co-workers. Realistically, I expect the US government to reach insolvency such that they can no longer pay my employer for my services before I need to pull the trigger on retirement.
I’m positive that Biden lacks all ability to understand the consequences. In a way, I hope the court rules that such a power exists. I’m the hands of a real president, this power can be used to dismantle the deep state. Seems to me, the left constantly thwarted Trump’s decisions about his management of employees, particularly saying he couldn’t fire DOJ and FBI employees.
It is possible to have this power and also prohibit a president from mandating an experimental gene therapy against an employee’s will. The same goes for any corporate CEO.
I’m a federal gov’t supervisor and one of my 9 direct reports is unvaxxed—she’s applied for a religious exemption which I plan to approve, but all approvals/denials of exemptions have been on hold since the beginning.
It all sounds strangely familiar...
Now if ye be ready that at what time ye hear the sound of the cornet, flute, harp, sackbut, psaltery, and dulcimer, and all kinds of musick, ye fall down and worship the image which I have made; well: but if ye worship not, ye shall be cast the same hour into the midst of a burning fiery furnace; and who is that God that shall deliver you out of my hands?
Perhaps the Biden government wants to make sure that there is no control group left which can provide comparisons showing how people dealt with Covid with and without this so called vaccine.
I’m the only one in my entire division in that control group still.
Could people who lost their jobs previously sue BiDung personally?
A mandate to be able to have employment is coercion and coercion is against federal law.
No vaccine for me.
Got Covid recently, cleared it after 10 days. Hell of a headache, lots of coughing. Treated with OTC meds.
There hasn’t been much news on this front lately. Good new though!
Same for my husband...age 71......me, I had the flu
I live in Memphis and only 2 places require me to wear a mask (the hospital where my wife gets wound treatment & the USPS. And only my local USPS branch postal service does this.
I have been to several other USPS branches and they do not enforce the mandate. My local branch does with a zeal that would make Biden proud.
They’re probably planning.
