The vote to overturn Roe v. Wade was 5-4. Alito wrote the majority opinion, joined by Thomas, Gorsuch, Kavanaugh, and Barrett.
The vote to uphold Mississippi’s abortion restriction was 6-3. Roberts voted with the majority for that outcome, but he said in a separate opinion that he would not have overturned Roe.

Robert joining makes me really uneasy. I wonder if this all wasn’t a ploy to enable Congress now to decide abortion and make it law of the land. I feel like Pelosi, Schumer, will use nuclear option soon to ram through abortion up to and including day of birth. This is an election year aftercall and using nuclear to make abortion legal gives them cover to do so.
Maybe just over-thinking a rare win that includes Roberts.

Yes, I think the current SCOTUS would say that mere federal legislation, not being an amendment to the Constitution, is Constitutionally the wrong way to “declare a right” that the Constitution does not declare.
I have always believed that for pro-abortion folks to remain in a truly constitutional mode, then from the beginning they needed to go the Constitutional amendment route, period. They avoided it because they knew the long political slog, in Congress and in the states that it takes to do that, and no guarantee of sucess; as has been the case the “women’s equal rights” amendment. They wanted and got Leftist judges to give them a quick judicial fiat fix; which was always wrong on the evidence and on the route taken.

Nothing in the decision says it's a state decision only. There is already talk of a federal solution.
