Japan court says ban on same-sex marriage constitutional

TOKYO (AP) — A Japanese court ruled Monday that the country’s ban on same-sex marriage does not violate the constitution, and rejected demands for compensation by three couples who said their right to free union and equality has been violated.

The Osaka District Court ruling is the second decision on the issue, and disagrees with a ruling last year by a Sapporo court that found the ban on same-sex marriages unconstitutional. It underscores how divisive the issue remains in Japan, the only member of the Group of Seven major industrialized nations that does not recognize same-sex unions.

In its ruling, the Osaka court rejected the plaintiffs’ demand for 1 million yen ($7,400) in damages per couple for discrimination they face.

The plaintiffs — two male couples and one female couple — were among 14 same-sex couples who filed lawsuits against the government in five major cities — Sapporo, Tokyo, Nagoya, Fukuoka and Osaka — in 2019 for violating rights to free union and equality.

They argued that they have been illegally discriminated against by being deprived of the same economic and legal benefits that heterosexual couples enjoy through marriage.

Support for sexual diversity has grown slowly in Japan, but legal protections are still lacking for lesbian, gay, bisexual and transgender people. LGBTQ people often face discrimination at school, work and at home, causing many to hide their sexual identities.

There are so many things to love about Japanese culture: Sushi, sashimi, saki, Sapporo beer, their politeness and respect, their work ethic, the women and all the cool techno gizmos they create, but I think number one is now their court system.

My goodness - a court that rules based on the definition of words...a court that believes it is bound by the concept of language.

A free country with some common sense. I can see the appeal of earning permanent residency there, as a brother, daughter and grandsons have done.

What I love best about Japanese culture is they don’t have “affirmative action” discriminating against Japanese people.

That is what high IQ is all about....

NO country, especially its courts need to justify their own constitution, laws, traditions, national mores or anything else by a comparison with ‘other industrialized nations.’

The premise is ludicrous; just as ludicrous as one of the leftist USSC judges once (IIRC a female - Kagan? Sotomayor? Ginsburg?) saying that she also considered foreign laws, treaties, etc. as part of the overall lexicon of discussing US Constitutional issues.

There is a reason for COUNTRIES - Sovereign Nations whose citizens have legitimized themselves unto the world and established their own laws, borders and governing documents.

Homosexuality is a global pandemic DISEASE of the soul, and it is largely promulgated by attacks like this in Japan (or the US). It will continue until they’ve taken the mile-over-the-inch and the public finally gets wise to it. I applaud Japan for their stand, frankly.
