U.S. Senate gun bill talks hit snag over mental illness, abuse provisions

WASHINGTON, (Reuters) - U.S. Senate negotiators, racing to settle details of bipartisan gun legislation, on Wednesday struggled to resolve serious disagreements over federal funding of state "red flag" programs and the breadth of a plan for keeping guns out of the hands of those prone to domestic violence.

Cornyn has raised concerns over a provision to fund state "red flag" laws allowing authorities to temporarily take guns away from people deemed dangerous to themselves or others.

Cornyn's home state of Texas does not have such a law and is seen as unlikely to enact one. He wants the federal funding to cover other efforts as well, such as outpatient "crisis intervention programs" for people suffering from mental illness.

Senators and aides have not said how much federal funding is at stake.

Lawmakers are also at odds over an effort to close the so-called "boyfriend loophole," which allows authorities to block abusive spouses from buying firearms - but does not cover people who are not married.

Christian Heyne, a vice president at the Brady gun control organization, called that "a loophole that defies logic."

Lawmakers have been unable to settle on who should be included in the provision, such as two people who only had one date, for example, or only those in a longer-duration relationship.

The entire concept defies logic.

If someone is a danger to themselves or others, they need to be detained.

The red flag stuff needs to die completely. Background checks that include juvenile records for under 21 applicants would have detected bad behavior in the Ramos (Uvalde) shooting. NICS is hobbled without that data. Form 4473 should be asking if the applicant uses SSRI drugs. Every mass shooter has been a user and that gets conveniently overlooked as a contributing factor.

Progressives slowly, and at great price, learn lessons long known by conservatives - learned over a long time at great price. If you don’t make certain legal commitments, you don’t get certain legal protections.

Let's simplify this whole debacle.

I've got the answers. Nobody will be allowed to own firearms unless they're at least 6 feet 5 inches tall with green eyes. Also, only those people are allowed to vote.

That's really going to solve a lot of problems.

Potential Red flags:
-I am a conservative - they say I’m mentally ill and dangerous
-I go to church regularly - they say I’m mentally ill and dangerous
-I don’t think men transgendered to women should compete in women’s sports - they say I’m mentally ill and dangerous
-I don’t think ANY adult, parent or not, should be coaxing young people under the age of 21 to transition to another gender - they say I’m mentally ill and dangerous
-I don’t think government should be mandating vaccines of any kind - they say I’m mentally ill and dangerous
-I think Federal government is too big and spends too much money- they say I’ mentally ill and dangerous
-I like oysters on the half-shell - they say I’m mentally ill and dangerous

Of course *wanting* a gun, or ammunition, will trigger the red flag provision because only someone mentally unstable and a danger to themselves or others would purchase such things..

The only provisions should be (1) Ending gun-free zones, (2) Helping formerly gun-free areas become secure or armed (More), (3) Serious mental health care, and (4) meaningful red flag laws.

If an location is to be gun free, they must provide on-site armed security, otherwise let citizens arm for their own defense. Best if they have location to check in guns upon arrival.

We need mental health care and, yes, institutionalize people that should be. Set up appropriate due process to commit, keep, and release people if they recover. Make it transparent and not hidden behind privacy.

We do need red flag laws. But they need to be transparent and public, need due process every step of the way, and have expiration, etc. It should be available and used in very, very limited, publicly transparent situations.

Both mental health and red flag laws should include legal representation, specific time limits, etc.

And put some very serious laws and penalties in place to prosecute and jail anyone that abuses them.

Focus on the people that are criminals, that have serious mental issues, and that abuse the laws, not the rest of the public that have legal, safe gun ownership and use.

And another thing, how about we enforce existing laws? For example, perjury on background forms. Start with Hunter Biden and the 15 million others that weren't so successful in buying guns.

And maybe a 10 year minimum for using a firearm to commit a crime or life sentence for a felon using a firearm to commit a crime. Get these criminals off the street, once and for all.
