Justice Samuel Alito Blocks Appeals Court Ruling on Counting Undated Ballots in Pennsylvania

Supreme Court Justice Samuel Alito issued a stay order Tuesday blocking the decision of a federal appeals court that required the counting of undated ballots in Pennsylvania elections.

A lawsuit challenging a 2021 local election in Lehigh County, Pennsylvania, involved voters who submitted mail-in or absentee ballots without including the date. Pennsylvania law requires that the voter both sign and date his or her ballot.

The matter eventually ended up in federal court because one provision of federal voting-rights law, 52 U.S.C. § 10101, purports to limit what sort of information a state can require on a state ballot. A federal district judge ruled in favor of the state law.

The U.S. Court of Appeals for the Third Circuit reversed. A three-judge panel consisting of two Democrat-appointed judges and one Republican-appointed judge held that the relevant provision of state law violated federal law. The Philadelphia-based appeals court accordingly ordered the undated ballots be counted.

While a local election in the Keystone State may not typically be a topic of national news, this ruling also has significant implications for other races. There are hotly contested races for governor and U.S. senator in the state. Currently, the top two candidates for the Republican nomination in the U.S. Senate race, Mehmet Oz and David McCormick, are only a few hundred votes apart. And of course, Pennsylvania is a critical state these days in presidential elections as well.

Alito issued a stay blocking the Third Circuit’s decision. The matter is likely to be referred to the full Supreme Court now.

This stay is only temporary.

One would think that a time stamp would be allowed, otherwise people could still be voting in the 2021 election.

Maybe he was one of them on the bench who wanted to hear the cases but there weren’t enough to get it on the docket. I dunno, but I’ll say this.

I believe that fraudulent election events of 2020 were certainly put in place by ‘accidents’ like Antonin Scalia ‘smothering himself’ with a pillow in the night.

The court has had time to SEE that the election was stolen, they are stepping in this time because they NOW KNOW the republic and constitution are at stake!! They NOW KNOW the Dems are stealing elections by breaking state laws!!!

I agree with you. Ann deserves a lot of credit for torpedoing Shrub’s asinine nomination of Miers. There may have been other voices on that, but Ann’s was the loudest and among the most aggressive. So... thank you, Ann. You did a great service to your country.

I forgot to include Gorsuch. He also wanted to ‘hear’/review the cases. I don’t share your confidence about Barrett. Recusal was not necessary. Do you think the leftists judges would recuse themselves on any issue? It took several weeks for cases to make their way to the SC, it wasn’t like it was the day after her confirmation.

The Signature and date are NOT written on the ballot, but on the outside envelope. They are analogous to showing id and checking in before in-person voting. Federal statutes do not prohibit simple check-in procedures at voting locations, therefore signing and dating a mail-in envelope in lieu thereof are not prohibited. The appeals court was too stupid to get that? Yeah, right.

The topic is the legal statement on the outside envelope you make under penalty of perjury with the required elements of signature, date, and location. Just like when you register your car - signature, date, location.
