There will actually be 16 jurors seated during the trial with four not knowing that they are alternates and will not be "in the room" when the case goes to the jury for a verdict.
Lengthy discussion regarding the infamous #SteeleDossier ...former British intelligence agent Christopher Steele cannot be compelled to testify so the dossier will enter the case tangentially in testimony from several witnesses, including #FusionGPS employee Laura Seago.

When asked if it would be a good idea to go to the FBI ahead of a possible story about Trump and Russia?
Elias says no, he did not think the FBI would “give a fair shake” to anything that was seen as anti-Trump and pro-Clinton.

Berkowitz says prosecutors claim that in September, the Clinton campaign was trying to plant the Alfa Bank story as an “October surprise.” He asks Elias to explain the meaning of that. “First of all, an October surprise comes in October.”

Elias said he did not authorize, encourage Sussmann to go to FBI, allegedly to warn agency about pending article in New York Times. He didn’t think going to the FBI was a good idea because it could have delayed the NYT from publishing the article. #SussmannTrial

FAKE NEWS STORY... There was no there, there. It was not news, it was deceptive lie that they wanted pushed. Once pushed in the news then they would have the intelligence agencies start investigate and spy on a Presidential Candidate Trump and start a coup attempt.
It will be interesting to see what evidence the prosecution has that puts the lie to those lies!

There was some discord regarding Elias’ testimony and whether it violated some agreement between the parties following Elias’ grand jury testimony when he said under examination, “You got to ask Mre Sussmann.”

Defense attorney Berkowitz asked for Elias to be disqualified. Prosecutor DeFilipis argued that “the government was very careful” to avoid the question that would elicit that response. “It wasn’t the government that prompted that response,” he said.

Judge Cooper did not grant that request, but said the defense could make an argument on the matter Thursday. Baker now on stand, discussing background. Unlikelly to get into much meat before coming back tomorrow. #SussmanTrial

Baker on the stand now. Prior to this, defense said they might move to seek a mistrial based on comments the govn’t made making it sound like Sussmann won’t testify. But that won’t be dealt with today. Unclear what will happen

It was not immediately clear what the defense’s concerns were, but it was in connection with a statement Elias made about Sussmann in response to a question. Sounds like we can expect filings later today spelling it out

“I kind of wondered how Michael had gotten my personal cell phone number” Baker said, though he was not freaked out because Michael was a friend.
Baker says he turned the text over to the govnt’ after they sought info for discovery purposes. “I am not out to get Michael and this is not my investigation,” Baker says to the prosecutor. “This is your investigation so if you ask me a question, I answer it.”
Now they are breaking for the day.

Proceedings have concluded with Baker on the stand. He will resume testimony again Thursday at 9 a.m. Berkowitz asked if defense should be ready for witnesses or a mistrial discussion regarding Elias’ testimony. “I am not inclined to rule a mistrial,” Cooper said.
