In a landmark 2008 ruling, the Supreme Court cited the right to self-defense in upholding the right to keep guns in one's home.
The question now before the court is whether that same right extends to the streets of New York.
What You Need To Know
-The Supreme Court is widely expected to strike down a New York law that limits the ability to carry a gun outside the home
-Currently, New Yorkers must demonstrate a special need for self-protection in order to obtain a concealed carry permit
-State leaders say they’ll craft new concealed carry restrictions that conform to the court’s ruling Mayor Adams says New Yorkers legally carrying guns will not deter crime or make the city safer
"This is not Jesse James and The Sundance Kids -- who can draw the fastest,” Mayor Eric Adams told reporters Friday, arguing that New Yorkers legally carrying guns will not make the city safer.
Officials are warning of dire consequences if the court rules against New York’s concealed carry law, which requires that you demonstrate a special need for self-protection in order to obtain a permit. The conservative-leaning court seemed skeptical of the law at oral arguments in November.
“Unless there’s a big surprise, based on this Supreme Court, based on how they asked the questions in the argument, the result here is going to be more people carrying guns in New York City,” said Michael Waldman, president of the Brennan Center for Justice at NYU Law School.
Waldman says the ruling could take many forms. The question is how much room it leaves for government regulation.
“They could say you don’t need a permit at all,” he said. “They could say you have to do what a lot of other states have done, which is to basically say you need a permit, but anybody who asks for it, gets the permit.”
State leaders are preparing for the worst, and say they’ll craft new legislation that goes as far as possible in restricting concealed carry while still conforming to the court’s ruling.
“I’m not expecting any great news from this Supreme Court,” said state Senator Michael Gianaris, a leading Democrat. “We’re not going to just sit back at a time of increasing gun violence and not react when the Supreme Court puts us in greater danger than we’re already in. So you can rest assured that the legislature will move very quickly.”
Mayor Adams, who has made removing guns from the streets a top priority, refuted the notion that law-abiding gun owners could deter crime.
“For those who are stating that if all the bad guys have guns, let's equal it out by having all the good guys have guns, that is just so dumb,” he said. “There's a tendency that people believe if they've got a gun, why have it, if I'm not using it? That's just the mindset of carrying a gun. We have to rid our streets of guns from good guys and bad guys.”
“They could say you have to do what a lot of other states have done, which is to basically say you need a permit, but anybody who asks for it, gets the permit.”
A Shall Issue system for NY? That would be a huge step forward. But I’m sure they will make it cost $5,000 and wait 4 years for it to be issued.

I grew up in the big town, and frequently visit relatives.
For someone who has (the dreaded) “Out of Towner” status, the worst aspect of NY’s and especially NYC’s gun laws is the refusal to EITHER issue nonresident permits OR extend reciprocity.
This means that there is no legal way to protect yourself unless you are a resident and have a permit.
Fixing the permit situation will not fix the residency issue. Even Maryland and New Jersey issue (rare) nonresident permits. Massachusetts nonresident permits are expensive but are not particularly hard to get.
I can’t wait for the ruling. It will also affect Maryland and a couple other states.
Hochul is already spreading disinformation about this and how this is why we had the shooting in Buffalo. Instead it was HER state police who interviewed the kid and gave him a clean bill of health to go out and buy guns.
Even if the court rules in favor of owners, the state can still make owning and using a legal labyrinth. Especially after this weekend’s shooting in Buffalo.
New York pledges millions to support Buffalo in wake of mass shooting: Gov. Hochul
No, it was the legislature that put you in danger.
“So you can rest assured that the legislature will move very quickly.”
Putting us in even greater danger...

Why you were safer on a NYC trolley in 1880 than today.

One would think that Good Guys/Gals/Those yet to decide with a gun could have ended that Buffalo WingNut in seconds.
Mass shooters always go where they know resistance will be lite.
If Good Folks with a gun won’t stop Bad Folks with a gun, why call the Police? They are not First Responders. Only a Mop Up squad.
YOU are the First Responder.
So what if "more people will be carrying guns"? It's the number of bad people carrying guns that should concern them.
OMG!!!! You mean we’ll have to stop trampling on Americans’ constitutional rights???? This is a catastrophe!
The left wants power. Everything else they say or do is window dressing to suit that one end - them monopolizing power in their hands.
They can’t have power if the people retain it...and an armed citizenry is a big impediment to the government having total power.
See my tagline.
The best way to advance gun rights would be for a SC judgment that forbade politicians at all levels, from utilizing armed security if they deny it to their constituents.
Which would STILL be an infringement on the 2nd Amendment.
The left don’t want good guys to carry guns. The criminal underclass is the left’s constituency. Whether you are a criminal, or it is your son, your brother, your cousin, you don’t want them to be shot dead in the streets while committing their crimes.
