Chauvin to receive 20 to 25 years in prison after judge accepts plea deal

Former Minneapolis police officer Derek Chauvin will receive 20 to 25 years in prison after a judge accepted a plea deal he struck with prosecutors in December.

In December, Chauvin pleaded guilty to charges of violating George Floyd’s civil rights when he pinned his knee on Floyd’s neck, killing him. In exchange, Chauvin agreed a sentencing between 20 to 25 years in prison.

Chauvin’s decision to enter a plea deal came after initially rejecting another plea offer in September.

While findings from Floyd’s autopsy revealed 11 nanograms per milliliter of fentanyl in his blood, medical experts called as prosecution witnesses agreed the amount of fentanyl was not enough to be considered fatal.

Dr. Daniel Isenschmid, a forensic toxicologist at NMS Labs in Pennsylvania, testified and presented data showing the levels of methamphetamine found in Floyd’s system were lower than the average amount found in 94% of DUI cases in 2020.

Cardiologist Jonathan Rich told the court: “I can state with a high degree of medical certainty that George Floyd did not die from a primary cardiac event, and he did not die from a drug overdose.”

Rich added had it not been for Chauvin’s restraint, he believes Floyd would have lived.

Dr. Lindsey Thomas, an expert witness who has reviewed documents and videos in the case, echoed Tobin’s testimony and noted the slow nature of Floyd’s death supports the conclusion that he did not die of a fentanyl overdose.

Two autopsies were completed after Floyd died in May 2020, following what video footage shows was roughly nine minutes spent pinned under Chauvin’s knee. The two reports found different causes of death, but neither ruled that Floyd died because of an overdose.

An independent autopsy ordered by Floyd’s family ruled Floyd’s death a homicide. The two doctors who conducted the autopsy concluded that Floyd died of asphyxiation, or suffocation.

The Hennepin County medical examiner’s office also ruled that Floyd died in a homicide. But it said the cause of his death was “cardiopulmonary arrest complicating law-enforcement subdual restraint, and neck compression,” which occurred while Floyd was being “restrained.”

In other words, Floyd’s heart stopped as Chauvin restrained him, as PolitiFact has reported.

That was a Facebook post that claimed he died of an overdose. As per the coroner he did not.

George Floyd’s heart disease and use of fentanyl were contributing factors to his death, but they were not the direct cause Hennepin County Chief Medical Examiner Dr. Andrew Baker ruled Floyd’s death s homicide and identified the cause as “cardiopulmonary arrest” that occurred during “law enforcement subdual, restraint, and neck compression” — thatswhat he testified in court.

Asked about the autopsy and Floyd’s death certificate, Baker described the “top line of the cause of death” as “what you think is the most important thing that precipitated the death.”

“Other things that you think played a role in the death but were not direct causes get relegated to what’s known as the ‘other significant conditions’ part of the death certificate,” he said. “For example, you know, Mr. Floyd’s use of fentanyl did not cause the subdual or neck restraint. His heart disease did not cause the subdual or the neck restraint.”

Floyd had hypertensive heart disease, Baker said, “meaning his heart weighed more than it should.” This meant Floyd’s heart needed more oxygen than a normal heart and was “limited in its ability” to provide more oxygen when there was a demand for it.

In the midst of an altercation and being held to the ground, adrenaline would pour into the body, Baker said, making the heart beat faster.

“In my opinion, the law enforcement subdual, restraint and the neck compression was just more than Mr. Floyd could take by virtue of those heart conditions,” he said.

He ain’t getting out vertical. When he gets out he will be in a horizonal position. This is a political persecution. Not a legal prosecution.

I read an earlier post on this.

The deal he made was that the state and federal sentences will be served concurrently.

In other words, for reasons unknown, he has given up on his state appeals before the state appellate court even begins to study his arguments.

If the state court throws out his conviction, he will still be in jail for 20 years on the federal charges, because he just pleaded guilty.

Makes no sense to me.

The Medical Examiner fully dissected Floyd's neck, tongue, throat, and back.

Zero evidence of trauma - so, death by asphyxiation (according to two prosecution doctors) with no injured tissues. How often does that happen? Like, never?

Also, one of the officers stated he heard Floyd snoring. In other words, they thought Floyd fell asleep from drug intoxication.

Also, 11 ng of fentanyl would be fatal for a non-user. If the prosecution proved that Floyd was a habitual fentanyl user, I did not see that testimony.

The only crime I saw proved in that court room was the criminal incompetence of Chauvin's lawyer.

Also, these articles all claim that Chauvin had his knee on Floyd's neck. Almost all the photos and videos do not support that claim. Also, almost all articles claim Chauvin's knee was on Floyd for more than 9 minutes. Incorrect - 8 minutes and 45 seconds.

None of the murder charges were proved beyond a reasonable doubt.

I have not studied the other charges sufficiently to have an opinion.

Chauvin needs a new trial and a new defense attorney”.

Shoulda had a change of venue, but the appeals will keep shortening his sentence.

Wouldn’t it be typical of the Communist-Rats, if Trump wins the 2024 Presidential election, and Biden then pardons Chauvin?

He wasn’t a saint. He was a minor criminal, but, as we see from his prior convictions, not a violent one.

However, that is irrelevant to the point that floyd did NOT die of a fentanyl overdose.
