SIGN UP Senator Mike Lee (R-Utah) on Tuesday said the Supreme Court ought to immediately release its final decision on Mississippi's 15-week abortion ban after a draft opinion for the case that would overturn Roe v. Wade was leaked to the media.
Chief Justice John Roberts has confirmed that a draft court majority opinion in Dobbs v. Jackson Women’s Health Organization published by Politico Monday is authentic. The opinion, written by Justice Samuel Alito, offers a full-throated rejection of abortion rights precedents established in the court's 1973 Roe decision and a subsequent 1992 decision in Planned Parenthood v. Casey.
“We hold that Roe and Casey must be overruled,” Alito writes. "It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives."
Roberts blasted the leak as a "betrayal" and has ordered an investigation to determine its source.

My thought ....very first thoughts other than being a bit shocked when I saw this late last nite after working and not seeing any news till late was precisely what Lee is saying.
Cut them off at the pass and don’t give Roberts room to twist arms or persuade nor for militants or regular Dems...is there much difference anymore .. to intimidate the ruling

The leak will benefit the GOP in the long run because it happened early enough in primary season to give voters a chance to prevent the general election from becoming a complete crap show. I’m not sure that changing the way the court operates by releasing a decision before they said they would will help them. At this point I think that the biggest danger to that institution would be a Democratic sweep in November, since the Democrats will absolutely pack the court, given the chance. The election will come down to turnout, and no-exceptions total ban Republican candidates in November would certainly drive that, to their detriment.
This whole thing is starting to come into focus, the hard-line abortion ban may be in service to the open borders agenda.
Lee is entitled to his opinion, of course.
But this just shows what a control freak HE is. SCOTUS, which is adults, will manage this as it sees fit, and assuming a smidgen of wisdom, will simply ignore all the unsolicited advice.
I don’t think of wisdom when I think of Roberts’s leadership of the USSC. But Roberts is clearly obsessed with the image of the Court and so Lee speaking publicly about such a potential response could conceivably give Roberts a bit more cover to go in that direction.

I despise Mike Lee, and wouldn't appreciate getting his unsolicited opinion. My public face would likely be "ignore," but if asked I'd say "thanks" and smile.
Lee's giving this advice in public, in order to advance Lee. That's his calculus.

Shocker! But it is an obvious argument.
Not so obvious is the suggestion that SCOTUS choose to not issue an opinion at all, using "tainted process" as the excuse. That too is within the prerogative of the court.
Each of us observers is going to come to a conclusion on the outcome (right outcome or not; process taint affected the outcome or didn't), independently of what is said and done. We'll each have our reasons too.

Some have suggested that the particular timing of the “leak”, which just happened to be the same day as “2000 Mules” was starting to be shown in theatres around the country, is more than curious. But whatever, the media was able to block out any mention of the rather damning movie. Ditto for conservative radio.
I saw the movie Monday evening in a packed theatre in Jacksonville, Florida. Was at least expecting conservative media to be all over it on Tuesday.
My bet is that Roe won’t be overturned when the decision is released . After this leak, two or three of the original votes to overturn will reverse themselves...only Alito and Thomas are sure bets to stick with their convictions. Roberts is going to put max pressure on the new justices to reverse themselves.
