Supreme Court ‘Draft’ Decision on Roe v. Wade LEAKED – Fingers Quickly Point at Potential Culprit

The U.S. Supreme Court is apparently planning to vote to END Roe v Wade in a DRAFT OPINION by Justice Samuel Alito — leaked to Politico this evening.

The draft opinion was leaked to the press – something that is almost unprecedented.

The Daily Mail reported:

The Supreme Court is planning to vote to strike down the decision of Roe v. Wade, long considered a vanguard of guaranteeing a right to an abortion in the United States.

The opinion draft – originally obtained by Politico – was written by Justice Samuel Alito, one of the six justices appointed by Republican presidents on the nine-member court, repudiating both Roe and the 1992 Planned Parenthood vs. Casey decision.

‘Roe was egregiously wrong from the start,’ Alito writes. ‘We hold that Roe and Casey must be overruled,’ he continues in the document, titled ‘Opinion of the Court.’

‘It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.’

Politico noted that this is the first such case in modern history of a Supreme Court draft decision being leaked to the public while the case was still pending.

It is unclear which justice would support such a move, which would typically be released at term's end -- by June.

But the fact that the planned decision was LEAKED -- which is considered a criminal act -- is almost as big a story as the decision, and it has shocked Court experts.

Influential site SCOTUSblog expressed the sentiment bluntly:

And it didn't take long for fingers to point at the most far-left justice on the Court: Sonia Sotomayor.

Some observations: 1. Justice Blackmun, who wrote Roe, admitted that there was no Constitutional justification for it, saying he got it from the "penumbras and emanations" of the Constitution. Even the late Justice Ginsburg, who supported the result, said it was wrongly decided. This presumptive decision, if it holds, is constitutionally correct.

2. This leak is a complete breach of legal ethics, possibly of the law itself, and the person who leaked it should be fired.

3. If you're going to call January 6 an insurrection, then you must call the demonstrations currently occurring at the Supreme Court an insurrection.

4. If this is the Court's decision, it will not end abortion, but will return it to the political arena and to the States.

However,

5. One could argue that the Fifth and Fourteenth Amendments, with their prohibition on taking "life, liberty, or property without due process of law," prohibit abortion. That would make it a matter properly in the Federal arena and require that it be outlawed.

It will be interesting to see how this plays out.

Wouldn’t put it past the dems for this to be all part of their plan. I’d put even money on a Breyer clerk who already has some sort of bulletproof lib law career lined up or a Kenjati Brown associate who got access to USSC files that s/he wasn’t supposed to normally have access to but were provided out of normal channels as a courtesy.

The scandal of the leak itself is going to be shouted down because the news (which was going to come out in due time anyway) is much more important. It also helps intimidate the fence-sitting conservative justices and their staffers letting them know that for the core issue of abortion, they’ll be willing and eager to go to lengths beyond what any historical norm or traditional boundary would normally stop them at.

Supporting abortion is easy. It carries no risk of being ostracized; indeed, among the elites, it is a prerequisite to being a member of the club. I remember Rush telling the story of the dinner party with supposed conservatives, who took him aside to criticize his loud opposition to abortion. Turns out they were forced to favor abortion by their wives, to keep peace at home.

The Question is presented - why violate all norms of the court to leak a decision of this importance at this time? From what other issue are they trying to distract us?

I assume they know something damaging will be happening and the election coming soon will be a loss for the deep state - so best to get people talking about back-alley abortions instead of the economy, war, the Ministry of Truth, Covid, and corruption.

They are losing power and they need us to look elsewhere.
