Lawyers for former Hillary Clinton campaign lawyer Michael Sussmann are furious at Special Counsel John Durham for describing an effort to spy on President Donald Trump while in office — and cited Breitbart News coverage in their response.
On Friday Durham filed a motion about the defense lawyers’ potential conflict of interest, including efforts to mine data about cell phone communications around Trump Tower, Trump’s private residence, and the Executive Office of the President in an effort to create a narrative about Russian “collusion”:
The Government’s evidence at trial will also establish that among the Internet data Tech Executive-1 and his associates exploited was domain name system (“DNS”) Internet traffic pertaining to (i) a particular healthcare provider, (ii) Trump Tower, (iii) Donald Trump’s Central Park West apartment building, and (iv) the Executive Office of the President of the United States (“EOP”). (Tech Executive-1’s employer, Internet Company-1, had come to access and maintain dedicated servers for the EOP as part of a sensitive arrangement whereby it provided DNS resolution services to the EOP. Tech Executive-1 and his associates exploited this arrangement by mining the EOP’s DNS traffic and other data for the purpose of gathering derogatory information about Donald Trump.)
On Monday, Durham’s lawyers responded, not only dismissing concerns about a conflict of interest but denying the allegations and complaining that they were prejudicial to their client’s case. They cited media coverage in conservative news sources — since the establishment media ignored the story — and included Breitbart News’ own coverage as an example.

Ditto beyond my pay grade. I've been retired from IT for quite awhile so I am not current on current IT practices. That said, I would expect the WH would have it's own DNS servers as part of the infrastructure. Those servers might not have been directly located in the WH. If the DNS servers were directly on the main WH network trunk, anybody with access to that unclassified network could put a packet sniffer on the trunk.
I noticed that Breitbert screwed up the 4th paragraph. It says that Durham responded but it is actually Sussman that responded.
This is above my pay grade, but I thought DNS servers resolved domains to IPs. If it was only intercepting DNS requests, than it would be more like spying on where traffic was being routed, and not necessarily logging any of the actual packet data. No?
If I’m right, that is plenty bad enough as it is. I’m not minimizing. I was just wondering. I think that Spoofing DNS services isn’t necessarily the same thing as a proxy that can log all of the data.

Not sure either. It might have been DNS cache snooping, which is basically seeing, as you mentioned, where requests are being directed. Sort of like the postman looking at the address of every letter you send.
Well, he has certainly had enough time to get his ducks in a row.
I really want to believe that Durham is a stand-up guy and is going to get to the truth but I have been so disillusioned by our 2 part justice system that I don’t expect anyone of significance to be held to account. Having said that, if Dunham really is serious then he has to know or strongly suspect that this scandal will implicate some very, very powerful folks, hence the need to build an airtight case. I can understand that.

I believe the filing with the court by Duham was to show there was a conflict of interest between Sussmann’s attorneys and the Tech exec #1. Durham is saying the attorneys cannot represent both parties as there is a conflict of interest. Durham wants the attorneys to either represent Sussmann, the tech Exec or withdraw.
The factual portion of the filing was to show the court the nature of the conflict.
While I am concerned about the statute of limitations (5-years, I believe) if this is an ongoing criminal enterprise, the statute can begin at the last overt act, so Durham may still have 3-years or more to bring prosecution.
I bet Marc Elias is starting to look over his shoulder. He’s the key to the whole operation. If they can flip him, she falls.

I’m with you. I’m so jaded by watching the powerful and the elites get away with murder and We The People are the joke all of this malfeasance is being committed against us and no one is ever held to account.
A seemingly endless parade of garbage in business suits who skate away into the sunset scot free.
The problem appears to be that those who ARE doing the crime believe that that their “connections” will keep them out of the “Big House.”
So far, it appears to be the case!
