Remembering the Black woman Biden blocked from the Supreme Court
American Enterprise Institute ^

President Biden wants credit for nominating the first Black woman to the Supreme Court. But here is the shameful irony: As a senator, Biden warned President George W. Bush that if he nominated the first Black woman to serve on the Supreme Court, he would filibuster and kill her nomination.

The story begins in 2003, when Bush nominated Judge Janice Rogers Brown to serve on the US Court of Appeals for the District of Columbia Circuit. The D.C. Circuit is considered the country’s second-most important court, and has produced more Supreme Court justices than any other federal court. Brown was immediately hailed as a potential Supreme Court nominee. She was highly qualified, having served for seven years as an associate justice of the California Supreme Court — the first Black woman to do so.

Don’t expect ANY MSM outlet to bring this up...It is now all about “checking off off a box” and putting a [fill in the blank] on the SC.

...and by the way - If you disagree, you’re a racist.

JRB is a great jurist. If I had magical powers, I’d body swap her with the one Biden picks.

All is forgiven and you know it. Let Fox News show the old hearing reels-won’t matter.

It never ceases to amaze me how the Corrupt-o-crats have orchestrated and created all the racist events in our country, but refuse to admit or acknowledge them.

Everything, repeat everything, Brandon touches turns to sh*t. Judicial appointments are no exception.

So how come Bush did not have enough guts to tell Biden to shove it?

Too bad we can’t find some video of Biden talking about this back in the day . . .

It should exist somewhere:

The following month, when Justice Sandra Day O’Connor announced her retirement, Brown was on Bush’s shortlist to replace her. She would have been the first Black woman ever nominated to serve as an associate justice of the Supreme Court. But Biden appeared on CBS’s “Face the Nation” to warn that if Bush nominated Brown, she would face a filibuster. “I can assure you that would be a very, very, very difficult fight and she probably would be filibustered,” Biden said. Asked by moderator John Roberts “Wasn’t she just confirmed?,” Biden replied that the Supreme Court is a “totally different ballgame” because “a circuit court judge is bound by stare decisis. They don’t get to make new law.”

Interesting. It's possible she would currently be Chief Justice now, as John Roberts was nominated initially to replace O'Connor, but then was nominated to be Chief Justice when Rehnquist passed away before he was confirmed to replace O'Connor as his nomination was already pending to avoid having to vet another nominee as it was more vital to replace the Chief Justice quickly, and O'Connor agreed to remain on the bench to keep a full court until her successor was confirmed - that ended up being Samuel Alito (after the withdraw of the disastrous Harriet Myers nomination).

And there's this, too:

According to internal strategy memos obtained by the Wall Street Journal, they targeted Estrada at the request of liberal interest groups who said Estrada was “especially dangerous” because “he is Latino, and the White House seems to be grooming him for a Supreme Court appointment.” They did not want Republicans to put the first Hispanic on the Supreme Court. So, Biden and his fellow Democrats killed Estrada’s nomination — the first appeals court nominee in history to be successfully filibustered. It paid off when President Barack Obama nominated Sonia Sotomayor as the first Hispanic justice.

This article could serve as a good template to use as a script for a series of campaign ads highlighting Biden and the Democrats' real record not only on Brown, but Estrada. Narrator: "Biden and his Democrats said Estrada was 'especially dangerous...because he is Latino' and they did not want him on the Court."

I have been waiting for someone in the media to bring this up.

I have spoken with the Judge several times; sharp brain and a very nice lady.

Remember when they passed the Affordable Care Act? Democrats had the power to do anything! Instead, they went into a state of legislative indolence and sat on gay rights bills, etc., and waited until the Republicans gained the power to stop it. Then they introduced the bills and blamed the Republicans for stopping them.

It must be nice having such a stupid voting block.
