Senate Democrats unveil proposal to reform Electoral Count Act

A group of Senate Democrats on Tuesday unveiled legislation that would reform an 1887 election law that has been in the spotlight in the wake of the 2020 election.

The proposal — from Sen. Angus King (I-Maine), who caucuses with Democrats, Rules Committee Chairwoman Amy Klobuchar (D-Minn.) and Judiciary Committee Chairman Dick Durbin (D-Ill.) — would clarify that the vice president's role overseeing the formal counting of the Electoral College vote is ceremonial.

The proposal comes after then-President Trump tried to get his vice president, Mike Pence, to throw out results from battleground states that he lost in the 2020 election.

It also increases the number of lawmakers in the House and Senate that need to support an objection before both chambers must vote on it. Currently, it just takes one member from the House and Senate; the legislation would increase it to one-third of both chambers. It also increases the threshold for upholding the objection from a simple majority in both chambers to three-fifths in both chambers.

The Democratic proposal would also narrow the reasons Congress can object to a state's electoral votes during the formal counting. And it would try to strengthen against the possibility of "fake electors," something that has flared up in the aftermath of the 2020 election, and set a deadline of Dec. 20 for states to resolve post-election disputes and make a final determination of the appointment of electors.

This is trying to NAIL down what Pence did not do... which he had the power to do... after the FACT.

To CHANGE this is not something that can be LEGISLATED. It must be an AMENDMENT to the Constitution, as the role of the VP is in the Constitution regarding the Federal Elections Electors as presented to the joint Session so designated.

These a@@holes know they stole the election, and want to prevent ANY dissent returning a slate of ELECTORS to States whose own legislative delegates demand it to be returned for re-consideration and certification of the actual head count vote by each county/precinct in the State.

Please post the full 1887 so called Election “Law” and then post the section/article of the Constitution that governs that legislation...created by REPUBLICANS to prevent another Democrat Tilden situation which required a “deal” to be worked out, giving the Presidency to Rutherford Hayes:

What they want to change is US Code Title 3 Chapter 1 § 15 - Counting electoral votes in Congress:

Congress shall be in session on the sixth day of January succeeding every meeting of the electors. The Senate and House of Representatives shall meet in the Hall of the House of Representatives at the hour of 1 o’clock in the afternoon on that day, and the President of the Senate shall be their presiding officer. Two tellers shall be previously appointed on the part of the Senate and two on the part of the House of Representatives, to whom shall be handed, as they are opened by the President of the Senate, all the certificates and papers purporting to be certificates of the electoral votes, which certificates and papers shall be opened, presented, and acted upon in the alphabetical order of the States, beginning with the letter A; and said tellers, having then read the same in the presence and hearing of the two Houses, shall make a list of the votes as they shall appear from the said certificates; and the votes having been ascertained and counted according to the rules in this subchapter provided, the result of the same shall be delivered to the President of the Senate, who shall thereupon announce the state of the vote, which announcement shall be deemed a sufficient declaration of the persons, if any, elected President and Vice President of the United States, and, together with a list of the votes, be entered on the Journals of the two Houses. Upon such reading of any such certificate or paper, the President of the Senate shall call for objections, if any. Every objection shall be made in writing, and shall state clearly and concisely, and without argument, the ground thereof, and shall be signed by at least one Senator and one Member of the House of Representatives before the same shall be received.

It’s not a ceremonial act - as the leader of the Senate he has the OBLIGATION to call for and accept objections if they’re made.

Meaning, for all to see and clearly understand,the VP is charged with the responsibility of notifying that each delegation must provide appropriate, unchallenged credentials.
To wit, when offered conflicting credentials the VP is required to return both delegations to the state for resolution. That was required of Pence to do. He failed to carry out his Constitutional duty.
