Meet Donald Trump, the constitutional scholar.
The twice-impeached former president is claiming that the bipartisan effort to reform the Electoral Count Act of 1887 proves that ex-Vice President Mike Pence had the legal right to overturn the results of the 2020 election that Trump lost.
“If the Vice President (Mike Pence) had “absolutely no right” to change the Presidential Election results in the Senate ... how come the Democrats and RINO Republicans are desperately trying to pass legislation that will not allow the Vice President to change the results of the election?” Trump asked.
Without providing any facts or legal precedent, Trump suggested the effort to clarify the 135-year-old statute means Pence would have been within his rights to reject the results of the electoral votes cast by the states on Jan. 6, 2021.

That's almost precisely the role he is given. It indeed has the full effect of what it says. You are adding to what it says.

His brother in Congress has Voted for all Biden’s spending.
Not hard to figure out.

You need to learn the meaning of ‘certify’”
certify
VERB
attest or confirm in a formal statement.
“the profits for the year had been certified by the auditors” · [more]
synonyms:
verify · guarantee · attest · validate · ratify · warrant · confirm · corroborate · substantiate · endorse · vouch for · testify to · provide evidence of · authenticate · document · bear witness to · bear out · give proof of · prove · demonstrate · back up · support
officially recognize (someone or something) as possessing certain qualifications or meeting certain standards.
“she was certified as a personal trainer”
synonyms:
accredit · recognize · license · authorize · approve · warrant · empower · qualify · endorse · sanction · vouch for · put one’s seal of approval on · appoint · give a certificate to · give a diploma to
Notice it does not say “just sign anything they give you”
He was certainly within his rights to listen to the objections, and delay ‘certifying’ it until the objections were addressed. It was done before, so there was even precedent.
I have to ‘certify’ work all the time in my job. If I certify something and it fails it is my head on a platter... so NO I would never ‘certify’ something if several of the participants expressed misgivings about it.
This issue will never be resolved. Some states were asking to send the votes back as they realized fraud and corruption. The Deep states overlords were just too much to overcome. Trump was in their way and they could not have him anymore. Trump won
“He had no such authority. And his job was to read them into the record...nothing more.”
So you folks believe the Founder’s intent was for everyone involved in the Electoral Process to robotically approve everything?
Then why have them do this at all?
No, in the face of evidence of fraud there is an obligation to at least delay certification until such time as any substantial questions about specific Electoral ballots are answered.
Absolutely!
He’s not rubber stamping anything. He’s reading the results into the record. Period.
“The Constitution does indeed clearly define the role and powers and does not grant the Vice President any such authority.”
Of course it does. It delegated that authority to Pence the exact same way that it delegated legislative and executive review to the Supreme Court (see Marbury v. Madison).
If the black robed demigods can do it then so can other officers of the Constitution.
Since the electoral votes themselves came from the states then yes, it was the job of the legislative branch to merely tally the votes they send. In this matter the states the authority.
“so NO I would never ‘certify’ something if several of the participants expressed misgivings about it.”
Very valid point, the VP failed his job in certifying the results when their questions to be still answered. If the VP did his job, we would either have Trump in Office or valid election. We have neither due to the VP.
Whether or not he had the authority, he was completely MIA while the Crime Of The Century was taking place. Not a word from him. You think he’s the type to fight for anything ? He’s a career politician. I think he actually wanted Trump out of office so he could put some distance between Trump and himself for his 2024 run.
___
I liked Pence, and still do. Not sure about what happened in the end. But, if he’s planning on running in 2024, he’ll go as far as Jeb! did.
Then why did he ask if objections were in writing and signed by a senator? If there was no purpose why ask the question?
Donald Trump may not be an authority on the Constitution, but he certainly can hire any number of such knowledgeable Constitutional authorities. And he has been known to take advice when he considers it to be sound.
The New York Daily News is not known to be even-handed in its approach to legal tangles. So they are building a straw man here, in the hopes of creating a spectacular blaze.
But the words of that law are pretty plain. The method of selection of the next President and Vice President is shifted from the Electoral College to the joint action of both Houses of Congress.
Funny thing is last week the GSA stated the election was not certified and THE LIAR IN CHARGE knows it thats why he went crying to the US Taxpayers to pay for his staff.
Until Trump states the election was won by Mr Dementia it stands as a uncertified election. Trump has enough money to fight this case an he is 1 fight at a time...Go read the constitution.
BINGO!!!
I have heard lawyers on both sides of this. I side with those who say that Pence’s authority was more limited. What is truly irresponsible is saying that Trump is responsible for violence simply by expressing an opinion shared by many lawyers and politicians.
You cannot require an office and then declare it has no authority.
any day now Trump will tell us he found the missing strawberries….
