Hang on to your hats: Breyer’s retirement sets up a bumpy confirmation battle
NY Post ^ | 27 Jan 2022 | Glenn Reynolds

Well, Justice Stephen Breyer announced his retirement — or, to be more accurate, someone leaked that he was going to announce his retirement in a few months.

That someone was probably at the White House, which has been desperate for a storyline that would distract from the failing economy and our disastrous foreign-policy failure in Ukraine, which came after our disastrous foreign-policy failures with Afghanistan and China.

Breyer is reportedly miffed about the leak but not so miffed that he’ll scrub his plans. His retirement is just another example, like the ongoing wave of Democratic congressional retirements, that Democrats expect to lose big in the midterms. So if he wants to be replaced by someone sufficiently leftist, he’d better see his successor confirmed while the Democrats still (sort of) control the Senate.

That means we’re in for another round of confirmation theater. As soon as the Breyer news broke, Jesse Kelly, channeling the Democrats’ fake scandal aimed at Brett Kavanaugh’s confirmation, announced: “Whoever Biden wants to replace him raped me in high school. I don’t remember where. Don’t ask me to come back to DC. I’m afraid to fly.”

If they pick a “moderate” = it’ll go smoothly.

If they pick a total leftist loon = bumpy but would be difficult to defeat a black female nominee absent some previously undisclosed evidence or accusation coming to light that sticks.

MSM is already writing the narrative, “White Republican party engages in attacking capable African-American Judge to Deny Historic Appointment”

“Brave Biden Stands by His Historic Black Woman Nominiee”

etc etc.

Never forget that the media portrayed Merrick Garland as a “moderate” “compromise” candidate to try to get a quick confirmation for him before Barry Soetero aka obama left office.

Now, garland is attacking parents who show up at school board meetings as terrorists. Once again the media lies, and freedom dies.

All that matters to me is that we nominate a Black, African-American Woman of Color to the Supreme Court because Black, African-American Women of Color, because of their darker color and boobies and vaginas and stuff, and because they are Black African Americans as well as Women of Color, should be judges and things on the Supreme Court for Justice.

Garland would’ve been a possible nominee but now he’s toxic after that leak.

It won’t happen, but the pubbies ought to go full-on scorched earth.

Throw every accusation, inference, innuendo, false flag and obstruction imaginable.

Then use the filibuster rule, and force the withdrawal of each and every Biden nominee. For EVERY position nominated. Until the next election. Utterly humiliate and denigrate every nominee.

Ruin their careers.

Cause familial breakups.

Make it as uncomfortable for them as they tried to do to Thomas, and Roberts, and EVERY Republican nominee, to the point where NOBODY wants to be considered, let alone nominated.

Full-on scorched earth. Show the bastards where their dinner hangs. Turnabout is fair play, and it’s well past time for turnabout to happen/

If Brandon nominates someone like Breyer, a not insane Democrat, the confirmation probably would be easy. But, the far left is determined to capture this nomination and nominate an insane lefty.

Brandon's first appointment to the Colorado bench was a good lawyer with a BigLaw background. She was a good choice for a lower court whose main job is to correctly apply the law. But the left went berserk and his second appointment was a far left nutjob and a partisan hack. Good luck if you represent a business or insurance company in her court.

A year ago Dems did a backroom power-sharing deal 50-50 on judiciary committee....The GOP members could stop from pushing to floor and the jackass party don’t have the 61 votes in senate for nuke option. Means dems are toast until mid-terms and beyond unless they cheat.

They don’t need 60 votes.
Barrett did not get 60.

LOL

“At any rate, there are only two people who really matter in this fight: maverick Dem senators Joe Manchin and Kyrsten Sinema. If the Democrats can’t hold them, everything is up for grabs. That means both Democrats and Republicans will be spending much energy trying to craft an approach that will please Manchin and Sinema. It should be a fun summer for those two, at least.

Or the Democrats could think out of the box and nominate — Donald Trump! Think about it: He’s liberal on a lot of social issues. He’s old enough that he won’t stay on the court that long. Sure, he’s not a lawyer, but the Constitution doesn’t require him to be. And this way, they won’t have to worry about him running for president!”

Wait. After the break there's one more paragraph:

Or the Democrats could think out of the box and nominate — Donald Trump! Think about it: He’s liberal on a lot of social issues. He’s old enough that he won’t stay on the court that long. Sure, he’s not a lawyer, but the Constitution doesn’t require him to be. And this way, they won’t have to worry about him running for president!

OK, that won’t happen. But it would be a lot more entertaining than what will.
