The mandate may well be upheld, but it won’t be 9-0. There is no reason for people to hit and run doom post like that.

I’ll lay out some predictions based on listening to the arguments rather than doom posting. These are a range.
45% 5-4 OSHA mandate is overturned. (Barrett, Kavanaugh, Gorsuch, Alito and Thomas)
15% 6-3 OSHA mandate is overturned. (Barrett, Kavanaugh, Gorsuch, Alito, Roberts and Thomas)
30% 5-4 OSHA mandate is upheld. (Breyer, Kagan, Sotomayor, Roberts, and 1 of Barrett or Kavanaugh)
10% 6-3 OSHA mandate is upheld. (Breyer, Kagan, Sotomayor, Roberts, Barrett, Kavanaugh).
I don’t know if Barrett is ignorant, but OSHA regular rule is NOW open for notice and comment. This is running in parallel with the ETS. Same protocl to the companies, no change there, but the regulation is there without the grave danger threshold.
Barrett kept asking “when does the emergency expire,” but ETS have a 6 month life, by statute. Whther or not the emergency expires, the ETS expires as a matter of statutory law.
Why, under the Consitution, should the people’s representatives not resolve the vaccine mandate issue?
