Roberts is clearly leaning toward removing viability as the Standard but leaving Roe and Casey “intact” in name, and reworking viability.
Clearly against us: Kagan, Breyer, Sotomayor.

He’s asking the question that way because the abortionists are using “liberty” as the foundation for not prohibiting abortion - under Roe, the foundation was “privacy.”
Going back to 14th amendment era is an agument that abortion is not a federal issue, not something that the drafters of the 14th amendment had in mind.
