That’s one of the quirks of the post NY Times v. Sullivan defamation law in the United States.
That case was wrongly decided and it and it’s progeny should be overruled. It provides far too much protection to the media.
Also, it’s far more complex than merely being accused of a crime.
I was thinking the same thing. The logic seems to be “everyone was defaming him. Since everyone was doing it, that made him a public figure. Therefore nobody was defaming him.”
Have you considered what being a “public figure” might entail?
